4 <br /> Chapter 40A. Mr. Fudala pointed out that some Board of Appeals would neve`grant a variance. Mr. <br /> McManus expressed his concern that applicants have reported that there has been no real vetting <br /> occurring when they have been considered by the ZBA, other than inquiring whether ConCOM had <br /> approved their application, The Board reviewed the examples provided. Chairman waygan suggested - <br /> taking a closer look and following up with the Building Commissioner with a note as to whether there <br /> was a direct finding of the four elements as described by Mr. Rowley. The Chair was seeking <br /> examples with the findings as described by Mr. Rowley in order to support a change to the law. <br /> pp g � <br /> The Chair will draft a letter. Mr. Weeden suggested inquiring about the number of applicants <br /> approved without meeting the four measures versus the number who were approved with the four <br /> measures. Mr. Rowley suggested that the Chair could inquire about the purpose of zoning to review <br /> the 50 foot setback, adding that it places an added responsibility on the applicant that it was essential to <br /> get the variance. <br /> Discussion of Planning Board review of Town road takings—proposed Selectmen's <br /> Policy-W.. Fudala indicated that the policy being drafted by Town Counsel had not been received. <br /> Chairman waygan indicated that she would email Town Counsel. <br /> Report on Status of Greenway Project-The Chair inquired whether Mr. McManus could draft <br /> a list of public agency owners regarding the Project. Mr. Fudala confirmed that U Fish wildlife <br /> had been approved and that the Mashpee Commons license was inp lace. Mr. McManus confirmed <br /> that a Notice of Intent would be needed once the engineering was designed. The Town Manager will <br /> issue the RFP for the engineering work. Mr. McManus will follow up with the Town Manager. lir. <br /> McManus noted that there was a list of engineers on their website. <br /> Design Review Committee-No meeting <br /> Community PreservationCommittee-The meeting will be moved to the first Thursday of the <br /> month and Brian Hyde and Anthony Bizzi have been added as a now members. <br /> Environmental oversight Committee- Mr. Cummings provided an update regarding <br /> Americorps work on the trails and trail mapping. Johns and Santuit Ponds have seen some <br /> improvements although there has been some vandalism occurring at Johns bond, Selectman Gottlieb <br /> has been working on amending the fertilizer bylaw to include Phosphorus, There was also an update <br /> provided regarding the success of the estuary restoration project with a 0% shellfish survival rate. <br /> Further expansion of the project will continue, some of it with help from the Tribe. <br /> Historic District Commission-No meeting <br /> MMR Military Civilian Community Council-Update of MAIR Joint Land Use <br /> Study-No update <br /> Cape Cod Commission-Mr. Weeden reported that he was in receipt of a letter explaining the <br /> availability of mitigation fundis totaling $907,070. CCC staff'was available to assist with utilizing the <br /> funds. Affordable housing and transportation were the largest amount of funds available. Mr. Weeden <br /> reported that nine separate projects contributed to the mitigation funds. <br /> CORRESPONDENCE <br /> -Email from Building Commissioner re: amending Zoning Section 174-25.A.(9)-Mr. Fudala indicated <br /> that the Building Commissioner wished to have the Planning Board consider the removal of the bylaw <br /> that prohibited the storage of travel trailers in R3 and Its, Mr. Fudala provided the history on the <br /> bylaw requiring review by Plan Review for owners wishing to store their RVs, Where was discussion <br /> regarding living adjacent to travel trailers and sugestions that it be limited to no more than one <br /> without a Special Permit and/or consider the size of the trailer, or not stored within any setback <br /> requirements. Planning Board members will further consider the request. <br /> -Falmouth Manning Board----Notice re: proposed Accessory Apartment zoning amendments hearing- <br /> Them was discussion regarding Mashpee's accessory apartments being interpreted. by Town Counsel <br /> as being intended for family members only, but Mr. Fudala indicated that it was in fact intended as <br /> 7 <br />
