7:20 p.m. Cape cot Islands Engineering for the Stopped Bus LLC <br /> The Chair read for the record the request and Public Hearing Notice. The Chair recognized Raul <br /> Lizardi-Rivera, Cape & Islands Engineering, who was representing the project proponents. Mr. <br /> Lizardi-Rivera explained the request as two properties, 147 and 155 Old Barnstable Road, seeking a <br /> Special Permit for the accessory use of a shared driveway. Mr. Lizardi-Rivera clarified that the Zoning <br /> Bylaw section for the request should be 174 I(14) and not(4). <br /> Mr. Lizardi-Rivera described the two-lot subdivision as being established in the 1980s. Lot#155 was <br /> isolated from Old Barnstable Road by an existing isolated wetland, fed by road drainage. Mr. Lizardi- <br /> Rivera indicated that lot#147 protected a 50 foot buffer on the wetland and the adjacent golf course. <br /> Rather than proposing a separate driveway over the wetland, the project proponent wished to utilize the <br /> existing driveway located at#147,extending it to reach #155 to create a shared driveway, instead of <br /> filling in a portion of the wetland. The project proponent was seeking approval for the accessory use <br /> of a shared driveway. <br /> Mr. Balzarini inquired whether the project proponent had been in contact with the Fire Department <br /> about sharing a driveway and their ability to turn around their trucks. Mr. Lizardi-Rivera responded <br /> that they had not yet been in contact with the Fire Department, adding that the center line was 220 feet <br /> with another 50 feet to Old Barnstable. Mr. Balzarini suggested that the Fire Department be consulted. <br /> Chairman Waygan stated that, due to the error in notification, the matter would need to be re- <br /> advertised with the correction, requiring a continuation. The Chair confirmed that the abutter's notice <br /> included the incorrect information. Mr. Lizardi-Rivera confirmed that the permit application included <br /> the correct section of the Bylaw and the Chair responded that it was an error made by the Town. <br /> Mr. Rowley confirmed that he had sent an email regarding Fire Department access. Mr. Rowley <br /> inquired why it was not possible to cross the wetland for the second lot and create a replication, <br /> avoiding both the need for a shared driveway and relief for a shared driveway. Mr. Lizardi-Rivera <br /> confirmed that they obtained approval from the Conservation Commission for the project, further <br /> adding that crossing over an existing wetland would create an ecological disturbance. The replication <br /> process would require filling in part of the wetland and replicating the wetland 2:1 which the project <br /> proponent wished to avoid, and would also require addressing additional drainage issues. Mr. Rowley <br /> noted that a culvert could be added to address drainage issues. Mr. Lizardi-Rivera added that there <br /> would be a loss to the lot by having to enlarge the wetland. Mr. Rowley suggested that replication was <br /> a possibility and it would be up to the Board to determine whether it would be an appropriate <br /> alternative to permitting a shared driveway. Mr. Rowley read his email, including the citing of 174-32 <br /> in the Bylaw requiring an all-weather surface within 50 feet of the dwelling or meeting requirements <br /> set by 174-32, including Fire Department approval. Mr. Lizardi-Rivera responded that they would be <br /> addressing the ZBA to request relief or Fire Department review. Mr. Lizardi-Rivera further noted that <br /> their request to the Planning Board was only to request a permit for a shared driveway. Mr. Rowley <br /> noted that a previous shared driveway request required a cul-de-sac to serve as a turnaround, a 16 foot <br /> width surface and a 20 foot clearance, as required by the Zoning Bylaw. Mr. Lizardi-Rivera stated that <br /> the project proponent did not advocate crossing the wetlands. Mr. Cummings and Mr. Balzarini <br /> expressed their preference to review feedback from the Fire Department. Mr. Weeden stated that he <br /> 2 <br />
