Marvas <br /> requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a <br /> pre-existing non-conforming single family structure on property located in an R-3 Zoning <br /> District, at 67 Riverside Road, Map 119 Parcel 68-0, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 22, 2019 and March 1, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,March 13,2019 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Scott Goldstein, Norman J. Gould, and Associate Member, Sharon Sangeleer. <br /> Also present was Building Commissioner, Michael Mendoza. <br /> Attorney, Geoff Nickerson, with Oppenheim and Nickerson represented the <br /> Marvas family and James with Longfellow Design & Building were also present. The <br /> application applies to the new raze and replace bylaw 174-17.1 that was approved at Town <br /> Meeting. The property has been in the Marvas family for over 70 years. It's a one story <br /> cottage that was built in 1970 within the R-3 Zoning District. The lot consists of 9,900 sq. <br /> ft. The existing house sits on a corner lot of Riverside Road and Snug Harbor Circle and <br /> the Board will have to consider that the lot meets the two setbacks. The front currently has <br /> 47.4 ft. from Snug Harbor Circle,and 16.9 ft. from Riverside, and is a two bedroom home. <br /> The proposed home will consists of a living quarters, a bedroom, and a kitchen on <br /> the first floor. The second floor will have two bedrooms. The design of the home will be <br /> consistent with the neighborhood. The existing lot coverage is 8.08%, and proposed will <br /> be 13.6%, and is well below the percentage allowed on a lot that is under 10,000 sq. ft. The <br /> current septic system will accommodate the three bedrooms, and the Conservation <br /> Commission has approved the project. <br /> 1 <br />
