Mr. Lehrer reported that Mr. Mooney submitted a request for the funds because the work was <br /> completed. The Chair responded that a formal letter stating the work was complete must be submitted. <br /> Additionally, the Chair would like for Mr. Rowley to conduct an inspection. Mr. Balzarini referenced <br /> the map, confirming that he had visited the site and had not seen that the trees had been replaced. It <br /> was Mr. Lehrer's opinion that the performance being held was for work to be completed for the <br /> original landscaping plan for the Phase III Windchime project. Mr. Rowley stated that initially a <br /> simplified plan was offered, replaced by a more intricate plan, as a response to the removal of the tall <br /> pines. Mr. Rowley agreed with Mr. Lehrer, and inquired about what the Board would want to review <br /> to identify what work remained. The Chair inquired about minutes from previous site visits, which <br /> Mr. Lehrer indicated had been provided in member packets, but Mr. Balzarini pointed out that the plan <br /> represented the trees removed just a few years ago. Mr. Cummings stated that there was a 2005 issue <br /> and then the more recent matter. The Chair stated that there were additional minutes for a site visit she <br /> attended, but Mr. Lehrer stated that the performance guarantee was not relevant to that project. <br /> The Chair stated that there had been walk-throughs where Windchime promised to complete the work, <br /> which she would like reviewed. There was further discussion regarding the initial landscaping not <br /> completed according to the approved plan. Mr. Rowley recommended that Windchime submit a letter <br /> confirming that the work was completed, in compliance with the original landscape plan, listing what <br /> was complete,which could then be inspected to confirm completion. If the landscaping was not <br /> complete, the funds could then be utilized to complete the work, according to the plan. The Chair was <br /> in agreement and requested that the additional, more recent landscaping site visit notes be located for <br /> further review. Mr. Lehrer will look into the matter further. The Chair suggested inviting Windchime <br /> to attend a future meeting and asked Mr. Rowley to visit the site. Mr. Rowley recommended that <br /> Windchime first submit their letter of completion. <br /> CHAIRMAN'S REPORT <br /> The Chair reported that Cape Cod Commission Engineer, Steve Tupper, would soon be <br /> releasing dates for public meetings regarding possible redesign of the Mashpee Rotary. Mr. Lehrer <br /> confirmed that the Board of Selectmen would be notified and would announce the information. Mr. <br /> Balzarini inquired whether the State was involved and the Chair responded that she would follow up to <br /> inquire. Mr. Lehrer stated that he had attended a preliminary meeting with the Commission, indicating <br /> that he believed that they were sharing a consultant with the State. <br /> Additionally, a memo was received from the Town Manager's office regarding the Light <br /> Industrial Overlay District proposed zoning bylaw, as well as a road taking. The plan for the road <br /> taking was provided to Mr. Rowley. The Chair inquired about scheduling a public hearing. <br /> MOTION: Mr. Balzarini made a motion to schedule a Public Hearing for the Zoning Article for <br /> the Light Industrial Overlay District for April 17 at 7:10 p.m. Mr. Cummings seconded the <br /> motion. All voted unanimously. <br /> The Chair asked that the road petition be added to the same agenda. <br /> BOARD MEMBER COMMITTEE UPDATES <br /> Cape Cod Commission-Chairman Waygan confirmed that notice had been received from the <br /> Cape Cod Commission that the Regional Policy Plan update had been approved, effective February 22, <br /> 2019. Technical Bulletins were also approved and the Planning Board's housing comments were <br /> 4 <br />
