Finally, as previously noted, the actions of the Tribe to operate its aquaculture grant off Punkhorn Point <br /> (around Gooseberry Island) are consistent with the express terms of the IGA. Section 2.(a) of the IGA <br /> specifically excepts from the Tribe's general release of land claims the parcels/ interests "described in <br /> Exhibits A and B",which specifically reference the 4.6 acre Punkhorn Point aquaculture grant site adjacent <br /> to Gooseberry Island.The IGA also reserves to the Tribe any aboriginal rights, as may be determined by a <br /> court of competent jurisdiction,to water, access to water or to hunt, fish or gather for sustenance. I do <br /> - not hereby express any opinion as to the=nature and extent of such aboriginal rights, if any; however, 1 do <br /> note the potential legal ramifications of such rights with respect to the Gooseberry Island grant. <br /> In summary, there are no additional plans of the subject aquaculture grant in the Town's files.
