MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE MASHPEE WAMPANOAG TRIBE (THE 44TRIBE") AND THE TOWN <br /> OF MASHPEE, MASSACHUSETTS (THE, 64TOWN99) RELATIVE TO COMMUNITY <br /> PRESERVATION FUNDNG OF THE MASHPEE PARSONAGE RESTORATION <br /> PROJECT. <br /> This Memorandum of Understanding (the "MOU") between the Mashpee Wampanoag <br /> Tribe ("Tribe") and the Town of Mashpee, Massachusetts ("Town"), hereinafter collectively the <br /> "Parties", relative to Community Preservation Act("CPA") funding of the Mashpee Parsonage <br /> Restoration Project (the "Project") is, entered into by and between the Tribe and Town effective <br /> RECITALS <br /> I w n or about November 3 05 2018, the ld Indian Meeting House Authority and the <br /> Mashpee Warr panoag Tribe's Historic Preservation Office submitted an Application to <br /> the Town of Mashpee Community Preservation Committee ("CPC") seeking CPA <br /> Funding in the amount of$400,000.00 as a partial source of funding for the Mashpee <br /> Parsonage Restoration Project, located at 431 Main St. Mashpee, MA. The total projected <br /> cost to complete the proposed Project as of the application date was $693,795.00. <br /> 2. Upon review of the Project funding application and deliberation regarding the same, the <br /> CPC, on January 24, 2019, voted "to approve and recommend to the May 2019 Special <br /> Town Meeting $400,000 for the Mashpee Parsonage Restoration project contingent upon <br /> prior execution of a Memorandum of Understanding between the fund recipient and the <br /> Board of Selectmen establishing milestones for full Project funding and a schedule for <br /> release of the subject appropriated CPA funds in relation thereto, and, further subject to <br /> the recording of a Preservation Restriction to assure that the subject historic property's <br /> intrinsic values will be preserved through any subsequent ownership by restricting the <br /> demolition or alteration of its significant historic features all as recommended by the <br /> Community Preservation Committee". <br /> 3. Thereafter, on May 6, 2019, the Mashpee Special Town Meeting, pursuant to Article 12 <br /> of the warrant and upon recommendation of the CPC, voted to "to appropriate and <br /> transfer the sum of$4M �, from the Community Preservation Fund Historic <br /> Preservation Reserve in accordance with the provisionsof'M.G.L. Chapter 44B §5, for <br /> the purpose of funding the Mashpee Parsonage Restoration Project 'including any <br /> necessary costs and expenses related thereto as recommended by the Community <br /> Preservation Committee, said sum to be disbursed subject to and contingent upon prior <br /> execution of a Memorandum of Understanding between the fund recipient and the and <br /> of Selectmen establishing milestones for full Project funding and a schedule for release of <br /> the subject appropriated CPA funds in relation thereto, and, further, subject to the <br /> recording of a Preservation IIestriction to assure that the subject historic property's <br /> intrinsic values will be preserved through any subsequent ownership by restricting the <br /> demolition or alteration of its significant historic teatures, all as recommended by the <br /> Community Preservation Committee"'. <br /> 4. The CPC in its deliberations regarding the aforementioned vote to approve CPA funding <br /> of the Project, noted the historic significance of the Parsonage and emphasized the need <br />
