Attached is the proposed <br /> bylaw required to comply with this control measure. <br /> Background <br /> Through the NPDES program,the EPA nationally regulates the discharge of stormwater runoff that is <br /> transported into local water bodies. Mashpee, as a small MS4, had to file a General Permit in 2003.This <br /> permit expired in 2008 but remained in effect until new regulations were issued by EPA in 2017. The <br /> reissued NPDES General Permit for Stormwater Discharges substantially increased stormwater <br /> management requirements and mandates specific timelines for compliance. Notices of intent for the <br /> new Permit had to be submitted by October 1, 2018. <br /> The purpose of the proposed bylaw is to explicitly prohibit contaminants from being released and/or <br /> entering the Town's stormwater system and ultimately into the Town's surface and ground waters. The <br /> bylaw also establishes an enforcement method for ensuring elimination of any illicit discharges found. <br /> Adoption of this bylaw is a requirement of the Town's General Storm Water Permit submitted to the <br /> EPA. <br /> The proposed bylaw is a model bylaw that has already been approved by the MA Attorney General's <br /> Office for other municipalities. <br /> Recommendation <br /> I recommend that an article be placed on the October 2019 Annual Town Meeting for adoption of the <br /> proposed Illicit Connections and Discharges to the-Municipal Storm Drain System General Bylaw, <br /> Pros and Cons <br /> Failure to adopt the proposed bylaw would be a violation of the Town's General Permit. <br />
