*DRAFT#1* OCTOBER 21, 2019 Annual Town Meeting Warrant <br /> Article <br /> To see if the will vote to amend Chapter 172-7(A)(3)(a) as follows: <br /> Replace the phrase "preexisting conditions"to "existing conditions"in the following sentence under <br /> this subsection "Such waivers are intended to be granted only in rare and unusual cases and only <br /> when resource protection would be enhanced relative to preexisting conditions" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation: The term "existing conditions" is a more appropriate term under the context of this <br /> bylaw subsection. <br /> Article <br /> To see if the Town will vote to amend Chapter 1.72-9 of the General Bylaws as follows: <br /> Amend the language of 172-9(A) to include the term "Adverse Impact" and its definition as follows: <br /> "Adverse Impact- adverse impact means an impact to the value or interest of a wetland resource <br /> area as defined by the bylaw that is deemed by the issuing authority to be more than negligible, or <br /> random, unnecessary or undesirable to the public interests of the resource area. Negligible means <br /> insignificant to the values or interests of the resource area" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation: The term "adverse impact" is commonly referenced in the regulatory language of the <br /> Massachusetts State Wetland Protection Act as a barometer of impact thresholds within wetlands <br /> jurisdiction. Adding this definition to Mashpee's Chapter 172 Bylaw will provide consistency of <br /> regulatory language and terminology, <br /> Article <br /> To see if the Town will vote to amend Chapter 172-14 of the General Bylaws as follows: <br /> Replace any reference to "office of Energy and Environmental Affairs"and its acronym "OEEA"with <br /> "Executive office of Energy and Environmental affairs"and its acronym "EJEEA" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation: The bylaw must accurately reflect any name/acronym changes in reference to other <br /> state agencies in the bylaw language.
