MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Glenn Thompson and Coreen A. Thompson <br /> 175 Daniels Island Road (Map 100 Parcel 41) <br /> Mashpee, MA 02649 <br /> SP-2019-28 <br /> Board Member, Ron Bonvie said in his opinion that the discussion regarding the <br /> impervious material would probably not need to return to this Board. The question is if <br /> there is a change to the canter lever of the foundation design, thus the footprint would be <br /> different, and as one member this might require the applicant to return to the Board. The <br /> variance would be with the Board of Health. <br /> Mr.Kirrane said that the front yard setback criteria will not change. It would merely <br /> be that the foundation would be further away with the canter lever. <br /> Sharon Sangeleer read the Conservation and DPW comments into the record. <br /> Charlie Maintanis,Building Inspector wanted to be certain that the new home meets <br /> the building code, height restrictions, and flood zone criteria. <br /> There were no more comments from the Board. <br /> GENERAL CRITERIA: <br /> The subject property located at 175 Daniels Island Road is approximately 13,200 <br /> square feet. <br /> There were no abutters present. <br /> SPECIAL PERMIT CRITERIA: <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History: Added 10-15-2018 ATM, Article 16, <br /> approved by Attorney General 1-9-2019. <br /> No pre-existing, non-conforming single or two (2) family dwelling structures shall <br /> be torn down and rebuilt on any lot unless there is an issuance of a Special Permit from the <br /> Zoning Board of Appeals. Such a Special Permit may be granted only if the Zoning Board <br /> of Appeals finds that any changes, extensions, alterations or reconstruction of the pre- <br /> existing non-conformities are not substantially more detrimental than exists prior to <br /> removal of the existing structure and that there is adequate land area to provide sufficient <br /> parking. In no case shall new non-conformities be permitted without the issuance of a <br /> Variance. <br /> 3 <br />
