*DRAFT#2* OCTOBER 21, 2019 Annual Town Meeting warrant <br /> Explanation: This article would allow the development of accessory apartments in the residential <br /> zoning districts of the Town as a by--right use. <br /> Article <br /> To see if the Town will vote to amend §174-3 of the Mashpee Zoning Bylaw-Terms Defined as follows: <br /> Accessory Apartment - An apartment created within or detached from a single-family residential <br /> structure under the provisions of§174-45.4. <br /> Dwelling Accessory - A residence created under the provisions of Section 174- 4613(1), containing no <br /> more than two (2) bedrooms,which may have kitchen and bathroom facilities and other rooms which <br /> are not bedrooms, either attached to or detached from a principle residence on the same lot and not <br /> owned separately from the lot or principle residence. <br /> or take any other action relating thereto <br /> Submitted by Planning Board <br /> Explanation: This article would change the definition of Accessory apartment.in the zoning bylaw to <br /> include detached structures. It would also change the definition of Dwelling Accessory in the Open <br /> Space Incentive Development (OSID) to.allow Accessory Dwellings permitted under OSID to have up <br /> to two (2) bedrooms. This would establish..cons.istency with th.e.accessory apartment definition. <br /> Article <br /> To see if the Town will tote to add`to the Mashpee.General Bylaw-Chapter 170 §6-B.6 as follows: <br /> The use of jet-ski watercraft, surf jet watercraft,.wet bike watercraft and other so-called personal <br /> watercraft which are motorboats is prohibited on Ashumet Pond, or take any other action relating <br /> thereto. <br /> Submitted by the Department of Natural Resources <br /> Explanation: This Article will add,.,.a.paragraph to the Town of Mashpee bylaw Chapter 170 §6-B. The <br /> Town of Falmouth has a bylaw with.the same wording and the Commonwealth of Massachusetts will <br /> not enforce the Falmouth bylaw unless Mashpee also has a similar bylaw.The Falmouth and Mashpee <br /> town line goes through Ashumet`Pond with most of the pond in Mashpee. <br /> Article <br /> To see if the Town will vote to add the following words to the Mashpee Town Code Chapter 170, <br /> Section 170-2, A: except as otherwise noted, and to replace Chapter 170, Section 9, Moorings with <br /> the following: <br /> A. After public notice and public hearing, the Board of Selectmen with input from the <br /> Harbormaster shall promulgate mooring rules and regulations. Notice shall be given at least <br /> two weeks prior to the public hearing by publication in a newspaper of general circulation in <br /> the Town and by posting with the Town Clerk and posting in the Harbormasters office. <br /> 22 <br />
