.� <br /> -'� <br /> � <br /> ' <br /> � <br /> PLANNING BOARD MINUTES: November 26, 198,15 � <br /> MEMBERS PRESENT: Chairman Richard Dubin , Richardson Jonas, � <br /> Michele Stone <br /> / <br /> TOWN PLANNER: Tom Fudala <br /> TIME : 8:00 p .m. <br /> Dick Dubin called the meeting to order . The first item on <br /> the agenda was the public hearing on Parades, Carnivals, <br /> Fairs and Fest | vals. Instead of reading the hole article <br /> Dirk Dubin decided to read the first line of the article <br /> which would describe what the article was about . There was <br /> a proposed change to the By-Law by adding section 4. 5. 15. <br /> Dick Dubin then asked if there were any questions or <br /> comments on the article . Being none , the hearing was <br /> clnsed. <br /> The next item on the agenda was the Home Occupations <br /> article . Dirk Dubin briefly discussed the article . Tom <br /> Fudala said that this article was submitted by the Building <br /> � <br /> Inspector . Gene Narr wanted to make an official comment on <br /> paragraph 3.F, he thinks that this needs to be clearafied. <br /> Earle Marsters thinks that it 's a good idea to avoid <br /> problems, the Planning Board should review the articles <br /> prior to advertisement . <br /> Dick Dubin went on to read the next article which discussed <br /> the Moratorium. Will Hanson asked if Dick Dubin had a <br /> letter from Town Counsel dated November 21 , 1985 and if if <br /> was appropriate at this time to read the first two <br /> paragraphs. Dick Dubin read the letter and at the bottom of <br /> the letter it stated that the article should be indefinitely <br /> post-poned at Town Meeting. Gene Narr stated the fact that <br /> they were going to amend the article to read in no way the <br /> article prohibits the reconstruction , addition to, repair <br /> of , any legally exsisting structure or septic system or <br /> water system. Further to amend the article to exclude all <br /> areas south of Route 28 in Mashpee . Dick Dubin stated that <br /> according to Town Counsels opinion you can not amend the <br /> article . Will Hanson asked who created the map? Tom Fudala <br /> said that he made the map to help out the Building Inspector <br /> interpret the article . Earle Marsters wanted to know who <br /> authorized Tom to draw the map . Tom Fudala said that the <br /> Building Inspector had a problem and he did the map to help <br /> him oot� along with the Board of Health Dick Dubin asked if, <br /> there were any questions on the article . Earle Marsters <br /> said that it was irresponsible of the Planning Board and <br /> Selectmen to advertise articles without making an attempt to <br /> see if the,,, are legal articles.
