Talun of ns4pee <br /> P. 0, BOX 1108 <br /> MASHPEE, MA 02649 <br /> PUBLIC HEARING NOTICE <br /> Pursuant to Chapter 40A of Massachusetts General Law, the <br /> Mashpee Planning Board will conduct a public hearing at 8 :05 PM <br /> on Wednesday, June 19, 1985 , at Town Hall, Central Road, Mashpee <br /> to see if the Town will vote to amend the Mashpee Zoning By-Laws <br /> by adding thereto the following new Section 11C and by amending <br /> the zoning map to show the ACEC area in conformity with a map <br /> dated November 26, 1979 and entitled "Waquoit Bay Areas of Critical <br /> Environmental Concern" which is on file in the Town Clerk's <br /> a ffice , or take any action relative thereto . <br /> f <br /> 11C AREAS OF CRITICAL ENVIRONMENTAL CONCERN (ACEC) <br /> 1. PURPOSE The purpose of this section is the protection of Areas of Critical Environmental <br /> Concern, areas of significance for flood control or the prevention of storm damage, <br /> waters containing shellfish and fisheries, and other public interests identified by <br /> the "Wetlands Protection Act" (M.G.L., Chapter 131, Sections 40 and 40A and the <br /> Town's Wetland Protection By-Laws. <br /> 2. GEOGRAPHICAL APPICABILITY This section shall apply to all areas Within <br /> the Waquoit Bay Areas of Critical Environmental Concern (ACEC) as designated <br /> by the Massachusetts Executive Office of Environmental Affairs on November 26, <br /> 1979 in accordance with M.G.L., Chapter 21A, Section 2(7) and to a buffer .zone <br /> extending fifty (50) feet land-ward from the edge of the ACEC. For those lots or <br /> land parcels totally encompassed by the ACEC, this article's applicability will be <br /> limited to one hundred (100) feet landward of the edge of wetlands as defined by <br /> hf.G.L., Chapter 131, Section 40. In case of any dispute regarding the boundary of <br /> the areas defined under this section, the Conservation Commission shall make the <br /> final dotermination based on the best available data. <br /> RE_EGMATION OF CONSTRUCTION AND LAND ALTERATION. <br /> (A) Within the above-described area, no construction of dwellings or any other primary <br /> or accessory buildings or structures, except those permitted under Section '6.3.1(9) <br /> pr Section 11C.3.(D), is permitted. <br />
