3 ialun of C as4pre
P. 0. Box 1108
MASHPEE, MA 02649
PIANMI G BOARD MINUTES : 4/24/85 P® 11
Mr, Dubin opened the public hearing to rezone a parcel of land. from
R-2 to C-2 , He read the notice as advertised_ in the newspaper (see
attached) ®
Pyre Marsters : This is the Woods ' old building which somehow got _put
in the wrong zone or didn't get included in the commercial zone .
Mr, Boyd : 1956 was the last time it was made mention in any of the zoning
maps . But somehow after 1956, 1972 it was mentioned but only slightly
and then disappeared. .
or, marsters : I think that was an oversight ,
Ralph Thayer: I 'm the owner of that building and the building , you heard
right . 1957 as far back as I could go that land in that area from Labute
hallway down to the Falmouth line was industrial land and then there was
a rezoning procedure to which some of -those records I dould not get a
hold. of. In 1970 _Paul Moods had that building built as a commercial
building . That building is assessed- now in the town hall as a commTcial
Wilding. Sometime between 1970 and when I took it over in 1981 it
had changed hands in 74 to a fellow who ran a little computer company
in there . He too had a commercial operation. I took it over in 1981 .
Had Gerry Garnet from Hyannis to do all my legal work and everything was
assumed was a C-2 rating, 1 had no suspicion of this up until last year
when I put it on the market . I had intention of putting in a small
precision machine business in there to do small machine components and.
I took an about face and did something else . We 've had a tenant in there ,
a kitchen manufacturer in there who 's running a comnercial business when
1 put it on the market 1 had taken deposits at that time . All this
came out in the wash , We made some investigations . I went back into
some of t,''10 old records trying to a.ind the original building permit ,
That building was built obviously as a. commercial building , That .goes
without saying , it was used as a commercial property and somehow when
they rezoned they cut that off and put it into the R-2 rating and what
1 did since this article was put in for the May 6 meeting . 1 had engi-
neering people come in town and go through the zoning boundaries . .I_
have for you a plan. It 's so obvious where they split it down the
middle of the road . So that 's the latest map. But it 's important that
I submitted that because the article that 's here submitted for the
meeting , there 's a slight revision in that based on that new map. That
revision is. just the boundaries ,
i r T'liarsters : What 're you saying? The article would- draw the line where .
Mr. Thayer: `.I`he article that was originally submitted for the meeting
was premature , This is the amended. article . It 's practically all the
