Tolun of I ng4pee <br /> P. 0, BOX 1108 <br /> Fj MASHPEE, MA 02649 <br /> PLANNING BOARD MINUTES : 4/17/85 P. 4 <br /> Mr. Dubin opened the public hearing on amending Section 6.2 of the Zoning <br /> By-Laws . Ile read the notice as appeared in the newspaper(see attached) . <br /> Mr . Dubin said the article was submitted by the Building Inspector and <br /> asked Mr . Boyd for his comments . <br /> Mr. Boyd : I think we felt that it had been -too inconsistent in the past . <br /> That everybody should be requested to post a bond . We were requesting <br /> the bonding for some people and not for others . <br /> Mr . Dubin: Can you give us a more general background, condo you mean® <br /> Mr . Boyd : No it can be a commercial building. It can be an industrial <br /> building '. It could be a condo. The only thing we have now is there <br /> is a bond required on all streets on any of the commercial areas or any <br /> of the town roads . That would have to be requested by the Building <br /> Inspector , <br /> Mr. Dubin: What 's the intent of the change . <br /> Mr , Boyd : It 's to make everyone post a bond, not some . <br /> Mike Makunas : So the Board of Appeals can impose the bond rahter than <br /> just the Building inspector . <br /> Mr. Boyd : The Board of Appeals would impose this bond which isn't done <br /> all the time so it could be done all the time from now on. We 're -trying <br /> to avoid a challenge in the future . We 're asking for bonds whereas <br /> I don' t -think we have a right to ask for bonds <br /> Manuel Costa : When some-thing comes up and the Design Review is request- <br /> ing a landscape plan there would be some-thing on the books rather than <br /> on a vote . <br /> Mr . Wlarsters . It 's good, it cleans it up nicely. There 's just one <br /> thing I wonder about is the whole area it 's confusing because in some <br /> places it says Planning Board, some it says Board of Appeals . It <br /> should say both in the case of multi-family, -the Planning Board should <br /> have the same power to do the same thing. I really support but I would <br /> like to see it also apply to the Planning Board . In multi-family the <br /> Planning Board could ask for bonds , like Seamist . <br /> Mr . Boyd : You can add an amendment on the floor of town meeting . <br /> Mr. Dubin: I think it 's clear, but in practica we haven't had any <br /> problem imposing the request of the bond! <br /> F 1,'r . Marsters : We ordinarily do anyway. <br />
