412.1.7 Location of affordable housing units. The affordable housing units shall be dispersed <br /> throughout a development. For multi-family developments, affordable housing units shall be <br /> dispersed throughout the buildings and the floors of each building such that no single building <br /> or floor therein has a disproportionate percentage of affordable housing units. <br /> 412.1.8 Comparability of affordable housing units. The affordable housing units shall be <br /> comparable to market-rate dwelling units in exterior building materials and finishes, overall <br /> construction quality, and energy efficiency, including mechanical equipment, plumbing, <br /> insulation, windows and heating and cooling systems. In addition: <br /> 1. When the affordable housing units are detached-single family dwellings, the affordable <br /> housing units shall be similar in size to the market-rate detached single-family dwellings <br /> in the development unless the Planning Board grants a Special Permit to authorize <br /> smaller units, and; <br /> 2. In any two-family or in any multi-family dwelling, the affordable housing units may differ <br /> from market-rate units in gross floor area, provided that the bedroom mix in affordable <br /> housing units shall be generally proportional to the bedroom mix in market-rate units, <br /> unless the Planning Board grants a Special Permit to authorize a different mix for the <br /> affordable housing units. <br /> 412.1.9 Timing of Issuance of Building Permits, Construction and Certificates of Occupancy. <br /> 1. No Building Permit shall be issued by the Building Commissioner for any project which <br /> contains affordable dwelling units until the affordable dwelling units have been shown <br /> to qualify as low or moderate income units for purposes of M.G.L., ch. 40B, sec. 20-23 <br /> and have been approved by the DHCD as eligible for the DHCD Ch 40B Subsidized <br /> Housing Inventory under 760 CMR 56.00, the LIP Program, as Local Action Units. <br /> The developer shall be responsible for preparing and complying with any <br /> documentation that may be required by the DHCD and the Town to qualify the <br /> affordable housing units for listing in the Chapter 40B Subsidized Housing Inventory. <br /> 2. No Building Permit shall be issued by the Building Commissioner for a rental <br /> development with affordable housing units until a regulatory agreement and monitoring <br /> agreement has been approved by the Community Housing Committee and Board of <br /> Selectmen and has been duly executed and recorded at the Barnstable County <br /> Registry of Deeds. <br /> 3. No Certificate to Occupy shall be issued by the Building Commissioner for a <br /> homeownership or rental affordable housing unit until the developer submits an <br /> affordable housing restriction, monitoring agreement and regulatory agreement that <br /> has been approved by the Community Housing Committee and Board of Selectmen, <br /> and the regulatory agreement has been duly executed and recorded at the Barnstable <br /> County Registry of Deeds. <br /> 4. In the event no building permits are required, then no Certificate to Occupy shall be <br /> issued by the Building Commissioner for any project which contains affordable <br /> dwelling units until the affordable dwelling units have been shown to qualify as low or <br /> moderate income units for purposes of M.G.L., ch. 40B, sec. 20-23 and have been <br /> 95 <br />
