restricted in such a way that future transference or leasing to non-family members comply with <br /> the applicable affordability requirements in Bylaw section 412.1. <br /> 412.5.6 Affordability. No Building Permit or Certificate to Occupy shall be issued by the <br /> Building Commissioner until the developer has demonstrated that all of the applicable <br /> requirements of 412.1 have been met. <br /> 412.5.7 Conditions and Restrictions. The Special Permit Granting Authority may impose <br /> conditions and restrictions on the special permit, including, but not limited to, a) restricting the <br /> total number of bedrooms or occupants in the dwelling, b) requiring that a Regulatory <br /> Agreement and/or Deed Rider, in an acceptable form, be executed and recoded by the <br /> applicant, c) such other restrictions or limitations as are considered necessary or appropriate <br /> to carry out the intent and purposes of the bylaw. <br /> 412.6 Conflicts with other bylaws. The provisions of this bylaw shall be considered <br /> supplemental to all other zoning bylaws. To the extent that a conflict exists between this bylaw <br /> and others, the more restrictive bylaw, or provision therein, shall apply. <br /> 413 WIND ENERGY FACILITIES <br /> 413.1 Residential Wind Energy Systems (RWES) Facilities. <br /> 413.1.1 Applicability, Purpose & Intent. This zoning bylaw shall control the siting, installation <br /> and use of Residential Wind Energy Systems (RWES) for single or two-family dwellings in <br /> residential districts R-87, R-40, RS-40 and R-25. It is the intent of this bylaw to facilitate the use <br /> of renewable, sustainable energy while at the same time protecting the public from any adverse <br /> effects of residential wind turbines on the character of neighborhoods, property values and the <br /> scenic, historic and environmental resources of the town. Residential Wind Energy Systems <br /> shall be allowed by right as an accessory to a single or two-family dwelling, except that a special <br /> permit shall be required from the Zoning Board of Appeals for the installation of any of the <br /> following: <br /> 1. More than one turbine on a single lot; <br /> 2. A RWES that requires an easement; <br /> 3. A RWES that will have an equipment shelter in excess of 150 square feet in floor area or <br /> multi-story; <br /> 4. A RWES that serves multiple properties; <br /> 5. A RWES that has a total extended height greater than 125'; <br /> 6. Above ground wiring, cables, or power lines. <br /> 413.1.2 Siting Requirements. <br /> 1. A RWES located on a residentially zoned lot must have its fall zone located completely <br /> within that property's lot lines unless the lot owner is granted a written easement(s) by <br /> 101 <br />
