Along with these opportunities,though, come the challenges of a rapidly changing development <br /> marketplace, particularly in retail, high costs of development and infrastructure, and uncertainty as to future <br /> regulations. A development agreement is an appropriate legal mechanism in that it involves a cooperative process <br /> where the parties can create a strategic yet flexible and mutually rewarding vested framework within which the <br /> project may succeed and the public benefits ensue. <br /> NO1 CRITERIA <br /> The proposal meets the criteria listed in Section 5(a)of the Chapter D(Development Agreement <br /> Regulations)for eligibility for a Development Agreement as set forth below: <br /> i. The project would benefit from a comprehensive review of the foreseeable and planned development to <br /> allow for the planning of efficient infrastructure.The development agreement approach also uniquely <br /> Incorporates the CCC's planning vision into the regulatory process thereby resulting in more efficient and <br /> comprehensive review process. <br /> ii. The project exhibits all three of the characteristics listed,including:a large land area(approximately 186 <br /> acres);the proposal involves multiple uses and structures;and the land consists of multiple parcels under <br /> control by the applicants. <br /> iii. Development under the proposed Development Agreement is anticipated to be built in phases over a <br /> period of time which would exceed 7 years. <br /> IV. The project involves future phases that are not fully or definitively defined. <br /> V. The Secretary of Energy and Environmental Affairs has issued several MEPA Certificates on the Property, <br /> the most recent of which.1s a March 2, 2001 Certificate on an FEIR for the"Mashpee Commons Master <br /> Plan" project. Following Cape Cod Commission certification that this proposal is eligible for a <br /> development agreement,the applicants intend to discuss with the MEPA office permitting for future <br /> phases of development. <br /> vi. The Town of Mashpee has submitted correspondence to the Cape Cod Commission in support of the <br /> applicants' request to enter into a Development Agreement, See Exhibit B. <br />
