Board members signed the authorization. <br /> Vote to Set Public Hearing Date for Submitted Zoning Articles for May 2020 Town <br /> Meeting-Mr. Lehrer reported that some Selectmen had concerns about the large scale projects, and the <br /> Articles may change, so it would be premature to schedule a date for a Public Hearing. Mr. Lehrer had <br /> scheduled a meeting with Selectmen and Planning Board members for Tuesday March 10 at 5 p.m. <br /> The Chair noted that she had been corresponding with Selectman Gottlieb regarding questions and a <br /> workshop had been proposed to discuss the Articles. Mr. Lehrer stated their concern as incentivizing <br /> large scale ground mounted solar arrays,which could promote the clear cutting of trees on large <br /> parcels. The Chair indicated that it was the Planning Board's understanding from Mr. Lehrer that the <br /> State did not allow the Town to prevent solar arrays and Mr. Lehrer confirmed that there was no case <br /> law for towns to identify reasonable restrictions. Mr. Lehrer stated that some towns had created <br /> overlay districts to allow solar arrays by right in certain areas of Mashpee. The Chair drafted questions <br /> to send to Town Counsel. Mr. Lehrer stated that the Board of Selectmen wished to not allow large <br /> scale solar facilities at all, unless it was a parcel already disturbed. Mr. Rowley noted that all approved <br /> Bylaws would be considered by the Attorney General's office and the Town would be notified if it was <br /> not allowable. <br /> Board members approved of the Chair's list of questions to Town Counsel,recommending changing <br /> "how"to "can." The Chair would see if the Selectmen wished to include their own questions to <br /> Counsel. The Chair noted that some towns had clearance bylaws. Mr. Phelan and the Chair would <br /> work on the matter with the Board of Selectmen and the Chair requested that the meeting time be <br /> changed to 6 p.m. The Chair suggested that the meeting be publicly noticed, suggesting that it could <br /> be a workshop allowing public attendance. Mr. Lehrer suggested that it was not intended as including <br /> a quorum of Board members and was unclear how best to post as a public event. The Chair <br /> recommended posting it as a workshop so that the public was duly notified of the matter. It was noted <br /> that the only concern expressed was regarding the large scale solar arrays. The Chair suggested that <br /> Mr. Lehrer confirm the deadline for making changes to the Warrant. <br /> BOARD MEMBER COMMITTEE UPDATES <br /> Cape Cod Commission-Mr. Callahan reported that there would be a Public Hearing for the <br /> Mashpee Commons' Notice of Intent at 3 p.m. on Thursday,March 5 at the Barnstable County <br /> Complex.
