Lehrer, 7bwn Planner <br /> Date: August 19,2020 <br /> Re: Inquiries relative to Delivery-only Marijuana Establishment licenses <br /> As requested, I have followed up with Town Counsel regarding a number of questions relative to <br /> Delivery-only Marijuana Establishment licenses: <br /> What is clear regarding Delivery-only licenses from the Cannabis Control Commission (CCC)?. <br /> • Delivery-only licenses will be offered only to 'Economic Empowerment'certified applicants for a minimum of <br /> two years. <br /> • Delivery-only licenses are indeed separate from retail licenses,however ambiguity within the statute remains <br /> as to whether or not,for the purposes of license limitations,a delivery-only license would be considered 'retail <br /> at the local level. <br /> • The state limits any entity from obtaining more than three (3) retail licenses throughout the Commonwealth. <br /> • For the purposes of this limitation, a delivery-only license is considered'retail'per CCC guidance. <br /> What remains unclear regarding Delivery-only licenses.? <br /> It was, and remains unclear,as to whether that statewide restriction applies to Mashpee's local zoning which <br /> places a cap on Marijuana Retailers to 20% of the licenses issued for the retail sale of alcoholic beverages pur- <br /> suant to M.G.L. c. 94G,§3 (a) (2). <br /> Because of this ambiguity within the statutes and CCC guidance documentation, Town Counsel <br /> submitted a request on 8/18/2020 to the CCC to opine on the issue. <br />
