4 <br /> Board of Selectmen <br /> Minutes <br /> August 24, 2020 <br /> APPOINTMENTS & HEARINGS <br /> Public Hearing: New Weekday and Sunday Entertainment License Application of Magni, Inc.: <br /> Jan Aggerbeck, Manager: (continued) <br /> Motion made by Selectman Gottlieb to approve the application of Magni, Inc., Jan Aggerbeck, Manager <br /> for a Weekday Entertainment License and License for Entertainment on Sundays at 10 Evergreen Circle, <br /> Mashpee for TV, Live/Recorded Music restricted to acoustic/non-amplified entertainment outdoors with <br /> outdoor entertainment ceasing at 10:00 p.m. <br /> Motion seconded by Selectman Sherman. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Cotton,yes Selectman O'Hara,yes Selectman Sherman,yes <br /> Selectman Gottlieb,yes Selectman Weeden,yes Opposed, none <br /> Public Hearing Adoption of a Local Regulation per G.L. c. 138, §23 and Board of Selectmen Policy #068, <br /> Alcoholic Beverages Licenses (Section III—Package Store All Alcohol), Banning the Sale of Alcohol Nips (50 <br /> mil) as a Condition of any New Renewed and/or Transferred License for Establishments Licensed Pursuant to <br /> G.L. c. 138 §15 Based on Considerations of Public Health, Welfare and Safety <br /> The Board of Selectmen opened the Public Hearing regarding the adoption of a local regulation per G.L.c. 138, <br /> §23 and Board of Selectmen Policy#068, Alcoholic Beverages Licenses (Section 111 —Package Store All <br /> Alcohol),banning the sale of alcohol nips (50 mil) as a condition of any new, renewed and/or transferred license <br /> for establishments licensed pursuant to G.L.c.138, §15 based on considerations of public health, welfare and <br /> safety. <br /> The Hearing notice as published was read aloud into the record. It was disclosed that several emails were sent to <br /> the Town regarding the proposed ban on the sale of alcohol nips. The information was included in the Board of <br /> Selectmen's packet. Copies are available at the Town Manager's/Office of the Board of Selectmen and on the <br /> Town's website for additional review. <br /> The Board opened the Hearing to solicit comment. <br /> Allison Cahir said the Board of Selectmen has no right to take a product away from a business instantly without <br /> a discussion. Banning nips will not solve littering or drinking and driving. Ms. Cahir indicated that it is unfair <br /> for the Town to slip this law into effect as it would potentially put these businesses out of business. <br /> It was noted if the Town votes to enact the ban it would not go into effect until next year. <br /> Raheel, a local gas station/convenience store operator with a seasonal liquor license conveyed the economic <br /> impact on the small business is a pressing concern. Due to the pandemic several businesses are closing. In <br /> comparison to last summer, his business is down by 25%, and it is projected to decrease to 35% in the off <br /> season. It was recommended that a deposit be placed on the bottles. With a surcharge, people would be less <br /> likely to dispose of them. <br />
