Mr. Phelan stated that he disagreed, adding that the distance of the tower from the property exceeded <br /> 1200 feet and some of the properties listed by Mr. Ronhock had no view of the tower. Mr. Phelan <br /> suggested that Mr. Ronhock's study was presented in the finding as superseding the analysis provided <br /> by the project proponent. The Chair stated that the project proponent's study did not consider property <br /> value and tax impact before and after tower installation, adding that the homeowners were best suited <br /> to determine whether the value of their homes would decline. Mr. Phelan again stated that the issue <br /> was a public safety matter and the Chair again stated the necessity to identify the location in the Bylaw <br /> that allowed cause for devaluation of property values as a public safety matter. <br /> Chairman Waygan agreed with the finding. <br /> Mr. Phelan disagreed. <br /> The Chair referenced page 3 of the findings but Mr. Phelan asked to dispense with the reading due to <br /> the lengthiness of the reading. <br /> MOTION: Mr. Phelan asked to dispense with the reading as Board members were in possession <br /> of the document. <br /> The Chair did not accept the motion. Mr. Phelan made a point of order, adding that the motion could <br /> be seconded for discussion. The Chair stated that the Chair was responsible for entertaining motions. <br /> MOTION: Mr. Phelan asked to dispense with the reading. <br /> The Chair indicated that if she did not read the findings in to the record, it could cause problems. <br /> Mr. Callahan seconded the motion. 3 yes, 1 no <br /> The Chair stated that she needed to read the document in to the record. <br /> BL UE SKY TOWERS II LLC HAS FAILED TO ESTABLISH THAT LESS INTR USIVE AND <br /> MORE COMPLIANT ALTERNATIVES ARE NOT AVAILABLE <br /> Blue Sky Tower II, LLC's application fails to establish that it cannot remedy any coverage gap <br /> by alternative measures that would inflict substantially less adverse impacts. Blue Sky Towers II, <br /> LLC has continually ignored that: <br /> 1. it can, infact,fulfzll its coverage needs through less intrusive and more zoning <br /> compliant means. <br /> 2. vast areas of coverage is open space and conservation land located in the Mashpee <br /> National Wildlife Refuge. These areas will be closest to the facility and would have <br /> the best and high quality coverage; and <br /> 3. the most densely populated areas of coverage are at the fringe of coverage, will have <br /> the least reliable coverage, and be most vulnerable to lose coverage as usage by <br /> other customers increase. <br /> Less intrusive and more compliant alternatives include <br /> 1. service coverage by the construction of an Outdoor Distributed Antenna System (ODAS) <br /> 10 <br />
