LEASE AGREEMENT
<br /> This Agreement dated March q 2020 between MORPJSON MARKETPLACE,
<br /> LLC of 259 Shore Drive, Unit 1, Mashpee, MA 02649 hereinafter called "Tenant", and
<br /> POPPONESSET MARKETPLACE, LLC, a Massachusetts Limited Liability
<br /> Company, with a principal place of business-at 12 Mallway, New Seabury, MA 02649,
<br /> hereinafter' called "Landlord". It is hereby mutually agreed as follows: In consideration
<br /> of the mutual promises, covenants and conditions contained herein, and other good and
<br /> valuable considerations, the parties agree,as follows-,
<br /> 1. LEASED PREMISES
<br /> Landlord rents and Tenant hires the Premises designated as.- Buil4iRgj, Popponesset
<br /> Marketplace, 259 Shore Drive, Mashpee, Massachusetts, containing approximately 1663
<br /> sqy are Jge VeLt, measured from the outside faces of the exterior wall and as shown outlined
<br /> in red on Exhibit A, attached hereto, including the existing equipment as listed on the
<br /> attached Addendum and made a part hereof. The Premises shall consist of a shell, with
<br /> finished ceiling, exposed stud wall, plywood floor and electrical outlet. Tenant agrees
<br /> that the Premises shall. be used solely for the purpose of#a nreneral store. Furthermore,
<br /> Tenant agrees that it has no right to sublease any portion of the Premises without written
<br /> approval of the Landlord.
<br /> 2. TERM
<br /> The term of the lease shall be for the period commencing April 15, 2020 and terminating
<br /> October 31, 2020 for minimum dates and hours of operation, as shown in Exhibit B,
<br /> attached hereto and made a part hereof. Tenant acknowledges that the Leased Premises
<br /> are situated at the Popponesset Marketplace, a seasonal operation, which is open from
<br /> May through October.
<br /> 3. DEPOSIT 1ffNTS*._AND RESERVE ACCOUN.T,
<br /> The provisions set forth in this paragraph shall be subject to the terms of Paragraph 36. If
<br /> Paragraph 36,does 'not apply, then the Tenant shall abide by the following:
<br /> (A) DEPOSIT
<br /> The Landlord acknowledges receipt of a security deposit in the amount of
<br /> $115,00.00. This deposit shall guarantee the Tenant a lease of the Premises,, as
<br /> described in Section 1. Furthermore,, said deposit may be used as a guarantee of
<br /> any funds due Landlord, including late fees, account balances and excess rents. In
<br /> the event that the Tenant adheres to all of the terms_, conditions, covenants and
<br /> obligations set forth. 'in this lease, the deposit shall be returned to Tenant no later
<br /> than November 30 2020.
