91 <br /> entering upon the open space for the purpose of maintenance, <br /> shall file a notice of such entry with the Town Clerk and at <br /> the principal office of the corporation, trust or association <br /> owning the open space, which notice shall contain a state- <br /> ment that the individual owners within the open space resi- <br /> dential development may become subject to ars assessment <br /> and lien for their pro rata share of the total cost of the <br /> maintenance. <br /> 9.37. BOARD OF APPEALS APPROVAL <br /> Provided the requirements, as set forth above, are met, <br /> the Board of Appeals may approve the use of land for an open <br /> space multi-family development provided the Board of Ap- <br /> peals finds that such use of the land <br /> i <br /> 9.371 Does not substantially derogate from the intent of <br /> the zoning,by-law; <br /> 9.372 The proposed use of the land shall not be substantial- <br /> ly detrimental to adjoining property; <br /> 9.373 The proposed development shall be superior to a con- <br /> ventional plan in preserving open space for conservation <br /> or recreation, utilizing natural features. of the land,:and <br /> allowing more efficient provision for public services. <br /> 9.374 The developer shall present the following to the <br /> Board of Appeals prior to or at the time of the hearing <br /> for the special permit; <br /> 9.3741 A topographic plan of the entire site showing 2-foot <br /> contour intervals and detailing existing structures and <br /> general vegetative cover masses; <br /> 9.3742 Sketch plan of the proposed development showing <br /> the following location and dispersement of multi-family <br /> structures within the parcel; <br /> 9.3743 Vehicular and pedestrian circulation patterns,road- <br /> ways, and parking area loctions; <br /> 9.3744 Open space including the locations of intended <br /> recreation facilities; <br /> 9.3745 Pertinent vegetation, soil and water conditions; <br /> 9.3746 Proposed utility systems. <br /> 9.3747 Detailed architectural plans including floor plans. <br /> 9.375 The Board of Appeals shall transmit to the Planning' j I <br /> Board and to the applicant the decision of the Board of <br /> Appeals within sixty (60) days of the date of hearing. <br /> 1 <br /> Approval shall be conditioned upon approval of the Plan- <br /> ning Board under the subdivision control law. j <br /> I <br /> IL <br /> I <br /> i <br /> I <br />
