Mr. Rowley noted that monuments served as a point of <br /> control so it made sense to use it for the lot line. Mr. Rowley inquired about the sewer easement at <br /> 1844, traveling to 1845, noting that there was no definition to the small easements, and suggested more <br /> definition. Mr. Bunker confirmed that 1842 and 1844 was being combined to create 1846, adding that <br /> the sewer easement had been created and would be recorded at Land Court, and an easement would be <br /> created. Mr. Rowley stated that although the easement was not substantially defined, it would be <br /> referenced in a Certificate of Title, and both would be connected. Mr. Rowley again recommended <br /> adjusting the lot line to the concrete bound, although it did not negatively impact the ANR, and Mr. <br /> Bunker confirmed that he would reconsider the adjustment. Mr. Rowley stated that the Board could <br /> vote based on Mr. Lehrer's review of the adjustment. The Chair invited any additional questions from <br /> members of the Board. <br /> MOTION: Mr. Balzarini made a motion to approve this ANR with the condition that Mr. <br /> Bunker will look at resolving the issue in Detail#2. Rowley Billing, Services May 2020-An invoice in the amount of$600 was received for <br /> services provided in the month of May for inspections and meetings. <br /> MOTION: Mr. Balzarini made a motion to authorize payment of$600 to our engineer for <br /> inspections and meeting attendance for the month of May. Mr. Cummings seconded the motion. <br /> Roll call vote: Mr. Balzarini-yes; Mr. Cummings-yes; Mr. Callahan-yes; Chairman Waygan-yes <br /> Request for Release of Covenant for Country Club Estates, Phase I-Ken Marsters was <br /> present to discuss his request for Country Club Estates. Mr. Rowley reported that he inspected <br /> construction work completed, as requested by the Board, for Phase I. Mr. Rowley had provided a <br /> report regarding his inspection, but noted that documents he used for his report were different than the <br /> documents provided to the Board, specifically as it related to security and a 10% retainer. Mr. Rowley <br /> has since reviewed the new document, and confirmed that the numbers would not change but the total <br /> price for road construction totaled $243,357, and included a 50% increase over the base amount of <br /> $162, 238.09. Mr. Rowley noted that the binder was completed, though it was listed, and should show <br /> as wearing surface. Mr. Rowley added that a list should be submitted regarding the specific lots Mr. <br /> Marsters was requesting to be released. There was discussion regarding a plan showing 26 starred <br /> properties, intended for release. Mr. Lehrer confirmed that a document had been prepared for the lot <br /> releases, by lot number, and reviewed by Mr. Marsters, but not yet provided to the Board. Mr. Rowley <br /> added that the security included upgrades to Payamps Road. In addition, Mr. Rowley noted that the <br /> remaining lots showing on the Country Club Estates plan would remain under covenant and could not <br /> be sold until completion of the additional phases, or until Mr. Marsters returns with additional security, <br /> as construction had not been completed beyond the last four lots on the plan. <br /> 2 <br />
