ACTION: <br /> Article 80 amended to read: <br /> To see if the Town will vote to add the following bylaws <br /> to Chapter III, Article VII to be numbered appropriately <br /> relative to inland waterways within the Town. <br /> Section 1 - SPEED REGULATIONS <br /> No person shall operate a motor boat, as defined in <br /> Chapter 90B of the Massachusetts General Laws on the ponds of <br /> Mashpee within (150) one hundred and fifty feet of shore at <br /> a rate of speed in excess of (6) six miles per hour. No '`"` <br /> person shall operate a motor boat in any area of any pond at a <br /> speed greater than (6) miles per hour during the period from <br /> one hour after sunset to one hour before sunrise. <br /> Section 2 - WATER SKIING <br /> There shall be no water skiing within (150) one hundred <br /> and fifty feet of shorelines , bathers , boats underway by means <br /> other than motors , or boats not underway, nor in shallow or <br /> narrow areas properly posted as "no wash" , "no wake" , or "6 <br /> MPH maximum speed" areas. Ski starts and stops shall not be <br /> permitted within (150) one hundred and fifty feet of any shore- <br /> line except that the Town may designate an area or areas <br /> which will be properly posted indicating that starts and stops <br /> are permitted from shore within this specified beach area. <br /> All turns shall be in a counter clockwise direction. No <br /> person shall operate a motor boat while drawing more than two <br /> water skiers at the same time. No person shall water ski <br /> except during the hours of from one-half hour after sunrise <br /> and one-half hour before sunset. There shall at all times be " <br /> a competent person in addition to the operator in a position <br /> to observe the person or, persons being towed. <br /> Section 3 - PENALTIES FOR VIOLATIONS <br /> u3 <br /> c <br /> Whoever violates any of the provisions of these regula- <br /> tions relative to the use of waterways shall be punished by <br /> a fine of not more than fifty ($50. 00) dollars except as <br /> provided in Section 14 of Chapter 90B of the Massachusetts <br /> General Laws relative to first offenders . <br /> Section 4 —ENFORCEMENT k: <br /> The Board of Selectmen shall appoint a Director of Inland <br /> Waters and shall appoint Assistant Directors of Inland Waters <br /> to serve for one year or until a successor is appointed <br /> and qualified, with police powers for each of the ponds within <br /> the Town to enforce the bylaws relative to use of waterways . <br /> Such persons to be at the recommendation of and responsible <br /> to the Mashpee Waterways Committee and the Selectmen. Duties <br /> and responsibilities of this position will provide full <br /> authority to enforce all laws , rules and regulations of the <br />
