Any violation of this bylaw may be punished by a fine of three hundred <br /> ($300.0O) per offense. <br /> PART 11 -GENERAL LEGISLATION <br /> CHAPTER 145 <br /> §145-2. Appointment of Herring Wardens. The Town Manager is authorized to appoint <br /> one (1) or more Herring Wardens and is authorized, from time to time, to make <br /> regulations concerning the opening and maintenance of ditches, sluiceways or canals <br /> into any pond within the Town not in private possession for the introduction and <br /> propagation in such pond or in any part thereof of herring, alewives or other <br /> swimming marine food fish and for the creation of fisheries for the same. No such <br /> regulations shall become effective until a public hearing has been held by the Board <br /> of Selectmen and public notice of the regulations adopted shall have been given. <br /> History: Amended 12-2-1985 STM,Article 5,2,approved by Attorney General on 2-11-1986. <br /> Submitted by the Bylaw Review Committee <br /> Explanation: Pursuant to the provisions of the Mashpee Home Rule Charter, Article 8, Section <br /> 8-5(a), the Board of Selectmen was mandated to appoint a seven person Committee to review the <br /> Town Bylaws for the purpose of preparing such revisions and amendments as may be needed or <br /> necessary to bring the Bylaws into conformity with the provisions of the Charter and to fully <br /> implement the provisions of the Charter. The Committee has submitted a Report to the Annual <br /> Town Meeting, recommending adoption of the amendments and revisions to the Bylaws printed <br /> in this Article, based upon its extensive review of the Charter and Bylaws. The Bylaw Review <br /> Committee conducted several public meetings under the supervision of Town Counsel, as <br /> required by the Charter, as well as a joint public meeting with the Board of Selectmen for the <br /> purpose of reviewing and discussing the current Bylaws and soliciting public comment thereon. <br /> The proposed Bylaw revisions set forth in the Committee's Report were highlighted in revised <br /> format and published on the Town's website as well as in a pamphlet available for public <br /> distribution in the Town Clerk's Office. As a result of these meetings and the public comment <br /> received on the proposed revisions, the Committee determined that the amendment, <br /> rearrangement and other revisions requested by this Article are necessary and appropriate to <br /> bring the existing General Bylaws into conformity with the provisions of the Mashpee Home <br /> Rule Charter and to fully implement the terms and conditions of the Charter. The objective of <br /> the Bylaw Review Committee was to update the Toven's Bylaws to the extent required for <br /> conformity with the Town. Charter and to reorganize the sequence of the existing General Bylaws <br /> for ease in implementation and internal cohesiveness. <br /> 32 <br />
