This amendment shall take effect immediately if it is ratified by the voters at the <br /> annual town election held in the year 2006, but otherwise it shall be without effect, or take any <br /> other action relating thereto. <br /> Submitted by the Charter Bylaw Review Committee <br /> Explanation: The Charter Bylaw Review Committee conducted a comprehensive review of all <br /> historical Special Acts adopted by the General Court of the Commonwealth relating to the Town <br /> of Mashpee and the governance of Town affairs prior to adoption of the Mashpee Home Rule <br /> Charter in 20�O�4. The purpose of this review was to identify any inconsistencies or conflicts <br /> between prior special legislation and the Home Rule Charter, and to determine which Special <br /> Acts are now obsolete or otherwise unnecessary for governance of Town affairs under the <br /> Charter mandated form of government. This Article seeks authorization to place a question on <br /> the ballot of the 2006 Annual. Town election to "'amend" the Home Rule Charter by repealing, <br /> partially repealing or retaining the previously adopted Special Acts so that there is no confusio�n <br /> or redundancy in the record of the Town's enabling legislation. The proposed repeal and/or <br /> retention of these Special, Acts will not take effect, as a matter of law, until ratified by the voters <br /> at the Annual Election in May 2006. <br /> The Board of Selectmen and the Finance Committee recommend approval. <br /> Motion made by Wayne Taylor. <br /> Motion: I move that the Town vote to order that the proposed amendment to the Mashpee <br /> Home Rule Charter, set forth in the Warrant as "Section 8-1-A: Disposition of Certain Special <br /> Laws", be submitted to the voters at the Annual Town Election in May, 2006, with the following <br /> revision of transcription errors: under the heading "'Special Acts Repealed: Action Taken <br /> 18 <br />
