D. After the recording of the third ojfense, the Animal Control Officer may <br /> request the Chief of Police to hold a hearing pursuant to the provisions <br /> of M.G.L. C.140 §157, and to make disposition oj'the dog in accordance <br /> with the provisions of said law. <br /> Submitted by the Police Chief <br /> Explanation: This, proposed Warrant Article amendment would provide for an update of the <br /> Town of Mashpee Bylaw (General Code) #120-2, Excessive Noise by Fags The minor change <br /> requested to this bylaw would enable the Animal Control Officer to request a hearing following <br /> the issuance of three (3) violation notices. Currently, there is no provision in the bylaw for a <br /> hearing to be held in order to deal with repeat offenders. The change requested in, this bylaw <br /> would also be consistent with the procedures outlined in Town Bylaw Chapter 79, and would <br /> therefore provide the Town with a uniform process for the disposition of animal related <br /> complaints. <br /> The Board of Selectmen recommends approval by a vote of 5-0. <br /> The Finance Committee recommends approval by a vote of -0. <br /> Motion made by Selectman Don Myers. <br /> Motion: I move Article 13 be voted as printed in the warrant, with the exception of the phrase, <br /> "or take any other action relating thereto". <br /> Motion passes at 80.33PM. <br /> Article 14 <br /> To see if the Town of Mashpee will vote to amend to the General Code, Chapter 79-4, Collection <br /> of Sum for U Rkeen by Town by deleting the paragraph in its entirety and replace it with the <br /> following, or take any other action relating thereto; <br /> §79- . Collection of Sum for Upkeep by Town., The Animal Control <br /> Officer having custody, of a dog confined under this chapter shall charge a <br /> dailyfiee to be determined by the Board of Selectmen for each day of <br /> con finement .for the care of such dog, payable by the owner or keeper <br /> thereof.' A ny sums so collected shall be paid over to the Treasurer or the <br /> Town pursuant to M.G.L. C. 44, §53. <br /> Submitted by the Police Chief <br /> Explanation: This proposed Warrant Article would provide for an. update of the Town of <br /> Mashpee Bylaw #79-4, Collection of' 'um for Upkeep bv Town. The minor change requested to <br /> this bylaw would enable the Board of Selectmen to set the daily fee rather than the fee being set <br /> at Town Meeting. This would provide for flexibility in the setting of the fee for this service and <br /> allow fees to change as economic conditions change <br /> The Board of Selectmen recommends approval by a vote of 5-0. <br /> 17 <br />
