Accept the Layout of Meadowbrook Road as a Public Way. <br /> Submitted by: Board of Selectmen. <br />.ry�y <br /> The acceptance of Meadowbrook Road as public road was approved at the October 2006 Town <br /> i Meeting. This article re-authorizes the previous taking in order to meet timely recording <br /> requirements set by State law. <br /> THE FINANCE COMMITTEE RECOMMENDS TOWN MEETING APPROVAL OF <br /> ARTICLE 13. <br /> JAI <br /> ARTICLE 15: Amendment to the Mashpee General By-Laws. <br /> Submitted by: Resident Petition. <br /> At the October 2007 Town Meeting, Article 13 was presented to amend Mashpee's Home Rule <br /> Charter which would have permitted any member of an elected board or commission to be <br /> appointed to any town volunteer board or committee. The Charter specifically prohibits elected <br /> officials from such appointments. This restriction specifically applies to the following elected <br /> officials: Board of Selectmen, School Committee, Library Board of Trustees, Planning Board, <br /> Town Clerk and Town Moderator. The Article did not receive the required 2/3rds plurality, and, <br /> . ; therefore, the proposed Charter Amendment was defeated. <br /> While this proposed amendment would appear to provide the desired"special case" mechanism <br /> to permit an elected official to serve on an appointed board or committee, the consensus of the <br /> 1 Finance Committee is that to avoid any appearance of a conflict of interest, the restriction placed <br /> on elected officials by the Charter should not be compromised. <br /> -1, THE FINANCE COMMITTEE DOES NOT RECOMMEND <br /> BY A VOTE OF 4 <br /> APPROVAL OF ARTICLE 15. <br /> ! <br /> ARTICLES 14, 17, and 19: Authorize Public Streets. <br /> Submitted by: Property Owners of Affected Private Ways. <br /> The following 3 articles are petitions by residents, whose homes are on what are now private <br /> roads, and who are requesting that their streets be accepted as Town of Mashpee public streets. <br /> The procedure for accomplishing this is a two step process, each step of which requires the <br /> approval by the voters at Town Meeting. Step 1 involves the authorization for the town to <br /> prepare the legal description of the streets to be accepted and sets a"not to exceed" amount to <br /> complete the task. Step 2 involves the approval of the actual, projected costs to bring the <br /> street(s) under consideration to municipal road construction and drainage standards and includes <br /> the authorization to bill the affected property owners as "betterment assessments". As a result, <br /> all the costs associated with both processes are borne by the residents of named streets, and <br /> there is no immediate impact on municipal expenditures.
