5. Operation by a person sixteen (16) or seventeen (17) years of age without first <br /> having received a safety certificate required by 323 CMR 4.03(2) <br /> C. All Personal Watercraft operators shall wear a wearable Personal Flotation Device (Type <br /> III or better; Life belts arenot acceptab�le.) <br /> §1.70-7. Swim Area. <br /> A. Public Bathing Area <br /> No Person shall operate a watercraft: <br /> 1. within one hundred fifty (15 0) feet of a pub�lic bathing area <br /> 2. within one hundred fifty (150) to three hundred (300) feet of a public bathing area <br /> except at headway speed. <br /> B. Private Swimming Area <br /> No person shall operate a motorboat within one hundred fifty (150) feet of the shoreline <br /> which is being used as a private swim area. <br /> §170-8. Divers and Diving. <br /> Any person or persons skin diving or scuba diving shall: <br /> A. Display a diver's flag constructed of rigidly supported material at least twelve by fifteen <br /> (12x 15) inches in area of red background with a white diagonal stripe. <br /> B. Display such flag on a boat or surface float extending a minimum distance of three (3) <br /> feet from the surface of the water, or to such other height in excess of three (3) feet as to <br /> be sufficient to be visible to passing boats. <br /> C. Stay in an area within one hundred (100) feet of such displayed diver's flag while at or <br /> near the surface of the water. <br /> D. Recreational diving or swimming in marked boat channels is prohibited. <br /> §170-9. Moorings, <br /> A. General <br /> 1. The location., type and adequacy of every marker, float, buoy, mooring, or fishing <br /> device (including but no limited to: lobster pots, crab pots, conch or whelk pots, and <br /> toad fish traps) must be approved by the Harbormaster or an Assistant Harbormaster <br /> before placement. Any marker, float, buoy, mooring, or fishin�,r device may be <br /> inspected, removed or relocated whenever, in the judgment of the Harbormaster or <br /> an Assistant Harbormaster, the safety of the other vessels or properties or maximum <br /> use of the area requires such action. The expense of such inspection, removal, or <br /> relocation shall be the responsibility of the owner. <br /> 37 <br />
