after notice has been posted at Mashpee Town Hall, or on or near the object, that he <br /> intends to dispose of the property unless it is claimed within ninety (90) days. The <br /> Town may use the property, if serviceable, for an indefinite period. When no longer of <br /> use to the Town, said property will be disposed of. Any costs of disposal may be <br /> assessed to the owner, if known. Any serviceable item of value will be offered for sale <br /> at public auction. All proceeds from said sale shall be used to defray the cost and <br /> expenses of removing, giving notice and sale, and the balance of the proceeds shall be <br /> turned over the owner or, if the owner is unknown, held by the Town Treasurer for a <br /> period of one (1) year, subject to claim by owner. After that time, the proceeds will be <br /> transferred to the Waterways Improvement Fund. Any property which is not serviceable <br /> or repairable will be discarded. <br /> §170-11. Pollution. <br /> The discharge or disposal of fuel, o�il, dead fish or their parts, waste, rubbish, debris, or sewage <br /> (whether treated or untreated) in the waters, shores or fo�reshores of Masbpee is prohibited. <br /> §170-�12. Operation of Vessels Under the Influence of Intoxicating Liquor or Controlled <br /> Substance. <br /> No person. shall operated any vessel on. the waters of the Commonwealth situated in, the Town <br /> of Mashpee under the influence of substances as described in Chapter 90B §8. <br /> 0 <br /> §170-13. Watercraft Equipment. <br /> All watercraft equipment operated in the Town of Mashp,ee shall meet the equipment <br /> requirements of 323 CMR 2.06. <br /> §170-14. Watercraft Operation without Personal Flotation Devices or in Overloaded or <br /> Unsafe Condition. <br /> A. No person shall operate a vessel. in the Town of Mashp�ee: <br /> 1. Without an approved wearable personal flo�tation device on board for each <br /> occupant, as required unaer Chapter 90B, §5 and 323 CMR 2.07 (10,14,15). <br /> 2. In an overloaded condition as defined in Chapter 90B §12A, and 323 CMR 2.07 <br /> (2) Guardrails. <br /> §170-15. Public Access Board Facilities. <br /> A. Mashpee Pond Boat Landing. <br /> 1. The Board of Selectmen may, after public hearing, suggest to the Public Access <br /> Board new or changed regulations over the maintenance and operation of the state <br /> owned boat landing at Mashpee Pond. Regulations adopted, approved, and <br /> promulgated by the Commonwealth shall become effective as of the date of <br /> publication in a newspaper having general circulation in the Town. <br /> 39 <br />
