To see if the Town will vote to authorize the Board of Selectmen to lease, or transfer fee title to, a portion. of that Town-owned parcel of land shown on the 1996 Mashp�ee Assessors Maps as Map 61, Block 3, to the Mashp�ee Water District, on terms satisfactory to the Board, with said portion to consist of two acres, more or less, fronting on Ashers Path, approximately as shown on a map entitled "Proposed Land Transfer to Mashp�ee Water District"' which is on file in the office of the Town Clerk as an attachment to this warrant article; and further, vote that such land shall not be held as conservation land pursuant to the provisions of section 5-27 of the Town By-Laws; and further, vote that the Board of Selectmen be authorized to submit a petition to the General Court to allow said lease notwithstanding any provisions of the General Laws to the contrary; and finally, vote to authorize the Board of Selectmen to enter into agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate such lease or transfer. Submitted by the Board of Selectmen Explanation: This article would authorize the Board of Selectmen to lease or sell to the Mashpee Water District approximately two acres of land on As,hers Path adjacent to the Transfer Station for the purpose of constructing a Water District office and maintenance facility. Motion made by Selectman Marsters. Motion: I move the Town vote, pursuant to Section 5-27 of the Town By-laws, that the portion of the Town-owned land shown on the 1996 Mashpee Assessors' Map 61 as Block 3, and more particularly shown on a map entitled "Proposed Land Transfer to Masbpee Water District" which is on file in the office of the Town Clerk, not be held as conservation land; to transfer to the Board of Selectmen for the purpose of selling to the Mashp�ee Water District the care, custody, management, and control of said land; to authorize the Board of Selectmen to convey said land to the Mashpee Water District; to authorize the Board of Selectmen to submit a petition to the General Court, if necessary, to authorize said sale; and to authorize the Board of Selectmen to enter into agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate such conveyance. Motion defeated at 10:02 p.m. Article 42 To see if the Town will vote to adopt the following resolution, a copy of which will be presented to the U.S. Secretary of Interior: WHEREAS the people of the Town of Mashpee have respect for the natural process and the role of all species in Cape Cod's natural habitat. THEREFORE we hereby petition the United States Fish and Wildlife Service to abandon the gull. extermination program that was implemented in 1996 and is scheduled to continue in subsequent years on Mo�nomoy Island in Chatham, Massachusetts.
