This amendment would extend that provision to lands <br /> acquired in the same fashion by the state. The intent of the bylaw and amendment is to reduce the <br /> costs associated with land acquisition for roadway improvements. <br /> Recommendation: The Finance Committee recommends approval. <br /> Motion made by Curtis Frye. <br /> Motion: I move the Town vote to amend the zoning bylaw by adding the words "or <br /> Commonwealth of Massachusetts" after the phrase "is acquired by the town" in the first sentence <br /> of Subsection 174-28.C. <br /> Planning Board voted at the Public Hearing held on September 16, 1998 4 to 0 for <br /> approval. <br /> Motion passes unanimously at 9:37pm. <br /> Article 38 <br /> To see if the Town will vote to authorize and empower the Board of Selectmen to prepare a plan <br /> laying out and defining Trout Brook Road, Yellow Perch Circle, Alewife Road, Bass Cove Circle <br /> and to accomplish said purpose and for expenses incidental and related thereto, the Town vote to <br /> raise and appropriate or transfer from available funds for appropriation a sum of money to the <br /> Account and to raise said appropriation the Treasurer with the approval of the Board of <br /> Selectmen be authorized to borrow at one time, or from time to time, a sum of money under and <br /> pursuant to Chapter 44, Section 7 or 8 or any other enabling authority and to issue bonds and <br /> notes of the Town therefor, and further, to see if the Town will vote to raise and appropriate or <br /> transfer from available funds a sum of money to the Roadways Account to provide interest and <br /> debt issuance expenses, or take any other action relating thereto. <br /> By execution of this Petition, the undersigned property owners hereby release all damage claims <br /> against the Town of Mashpee resulting from construction or eminent domain taking of any land <br /> necessary for laying out of Trout Brook Road, Yellow Perch Circle, Alewife Road, Bass Cove <br /> Circle. <br /> Submitted by Petition <br /> Page 62 of 63 <br />
