Mr. Lehrer said he informed <br /> everyone at the last meeting that the Town was anticipating zoning articles submitted by petition <br /> relative to the solar energy systems at the property off of Route 151 owned by Mr. Haney. <br /> Those petitions were submitted and certified by the Clerk. He said since he knows the petition <br /> was certified he asked the Board to set a Public Hearing Date for the second meeting in March <br /> since it is the first meeting after the Selectmen would have had the opportunity to review the first <br /> draft of the Town Meeting Warrant. He indicated that it is only the petitioner who has the power <br /> to request any changes to the articles. He said if any changes were to occur he wanted to allow <br /> enough of time between the Public Hearing and the Town Meeting so that a written notice can go <br /> to the petitioner to request a modification to the petition. Ms. Waygan asked if there were <br /> substantial differences would another Public Hearing have to be held. Mr. Lehrer responded that <br /> if the scope of the articles were altered then another Public Hearing would have to be held but <br /> that this would probably have to go to Town Counsel. He said previously there was discussion about having <br /> counsel prepare written analysis of the legislation but feels that that review is something that <br /> staff could perform and deliver to the Board. He said that he has not submitted a request for <br /> legal counsel for a full analysis of the Economic Development Bill since there are only a few <br /> specific provisions that impact housing development. <br /> New Seabury—The Cottages Phase IV Update—Mr. Lehrer said that he did receive the Mylar <br /> with Land Court revisions. It was provided back to New Seabury for recording. He added that <br /> New Seabury has provided a check of$1.4 million to the Treasurer to secure the rest of the <br /> roadway construction and installation of utilities so a covenant will no longer need to be released <br /> because the Town is holding the funds. He indicated New Seabury has already submitted <br /> building permits for the subdivision which he has not signed off yet since the subdivision plan <br /> has not yet been recorded. <br /> 13 <br />
