8 <br /> Community Preservation Committee <br /> Minutes <br /> January 14, 2021 <br /> APPOINTMENTS & HEARINGS <br /> Review Discussion&Possible Action on the followingCPC Application proposed for the May <br /> 2021 Town Meeting: (continued) <br /> CPC member Dawn Thayer expressed an interest in the property for town ownership as a great <br /> addition to open space. However,there are several concerns regarding procedural issues. Of <br /> importance is the matter of outstanding litigation and the potential responsibility of the CPC to <br /> assume legal costs in litigation. <br /> With regards to protocol,the article was recommended by the Select Board and placed on the <br /> warrant for use of Community Preservation Act funds before approval was formally granted by <br /> the Community Preservation Committee. <br /> In following the mandates of the Community Preservation Act there was also a question <br /> regarding the legal process. Does the property to be purchased and/or taken by eminent domain <br /> require a 2/3rd's vote of approval from Town Meeting before approval is granted by the CPC? It <br /> was recommended the process and applicable laws be reviewed before the CPC makes a decision <br /> on this property. It was agreed Town Counsel would be consulted with respect to this regard. <br /> With respect to the eminent domain process, it was agreed that language relative to former land <br /> acquisition articles will be reviewed for the consistency. <br /> It was noted the deadline to submit articles for the May 2021 warrant is Monday,February 8, <br /> 2021. It was recommended the CPC move forward with an appraisal of real value for this <br /> project as in normal course. A quote has been secured from a local appraisal firm. <br /> In concern with respect to funding this project it was disclosed the CPA surcharge will be <br /> reduced from 3%to 2% in FY2022. <br /> Motion made by Ms. Waygan to authorize an appraisal of real value for the"Acquisition of <br /> Gooseberry Island" project for a sum not to exceed $3,000. <br /> Motion seconded by Mr. Smith. <br /> VOTE: 5-3-1. <br /> Roll Call Vote: <br /> Mr. Gottlieb,yes Mrs. Thayer, yes Mr. Hyde, abstained Mr. Halpern, no <br /> Mr. Larkin, no Ms.Waygan,yes Mr. Harsch, no Mr. Smith,yes <br /> Ms. Barbee,yes Opposed, (3) <br />
