burned. Mr. Harrington answered this was an illegal burn event, as documented by the Fire Department,
but that he would consider it a nuisance at this point. He would need to have soil or groundwater
concentrations to know if it is reportable to DEP. Mr. Harrington stated that a Cease & Desist Order was
certainly warranted. Chair Baumgaertel agreed and requested further investigation into what exactly was
burned. Ms. Warden suggested that a copy of the Order Letter be provided to DEP, and Mr. Harrington
stated that, while we don't have enough information to bring them down to the site, it is prudent to keep
them in the loop. Mr.Virgilio asked if a formal report was being prepared by anyone.,and Mr. Harrington
answered that the Fire Department would have done a full incident report, because an engine and a
tanker had to respond.
There being no further comments or discussion,Veronica Warden moved to issue a Cease & Desist Order
at 73 Lovell's Lane. Motion seconded by Ernest Virgilio. Ernest Virgilio(yes);Veronica Warden(yes); Brian
Baumgaertel (yes). VOTE: Unanimous(3-0).
NEXT MEETING
Due to Mr. Harrington being on vacation the week of the March 18th, the next meeting of the Board of
Health was scheduled for Thursday, March 25, 2021 at 7:00 PM.
There being no further business, Veronica Warden moved to adjourn the Public Session Meeting of the
Board of Health at 8:58 PM.
