Surette Bk.: 760 <br /> 26 Greenwood Road Pg.: 76 <br /> (Map 117 Parcel 179) <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 1,2019 by Leo Surette requesting a Variance from the front <br /> yard setback under§174-31 fn. 19(Land Space Requirements Table)of the Zoning Bylaws <br /> to allow for construction of a deck on property located in an R-3 Zoning District, and <br /> Popponesset Overlay District, at 26 Greenwood Road,Map 117 Parcel 179,Mashpee,MA <br /> 02649. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on August 9, 2019 and August 16, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> September 11, 2019 at which time the following members of the Board of Appeals were <br /> present and acting throughout;Chairman,Jonathan Furbush,Board Members,Ron Bonvie, <br /> Scott Goldstein and Associate Members, Sharon Sangeleer and James Reiffarth. Also <br /> present was Building Inspector, Charlie Maintanis. <br /> Leo Surette, homeowner represented himself for his deck project. He started construction <br /> on his front deck and incorrectly measured thinking he could measure 25 ft. from the road <br /> instead of from his property line. As a result he was told to file for a Variance with the <br /> ZBA. <br /> In 2016, he razed and re-built a new 2-bedroom home with a deck on a slab with flood <br /> vents and retaining wall. He provided the Board with photos of the deck, and the <br /> neighboring homes that have similar decks that are located closer to the road than his deck. <br /> He also provided letters from his neighbors stating they had no problem with the proposed <br /> deck. The Board had a conversation regarding the dwelling being located in a flood zone, <br /> and it was determined that it was not located in any wetland resource area as stated by the <br /> Conservation Agent. <br /> 1 <br />
