Rainville, Trustee Doc.: 1330719 <br /> 19 Keel Way Ctf.: 214163 <br /> (Map 120 Parcel 138) <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 2,2019 by Owner,Julieann E. Rainville,Trustee requesting <br /> a Variance from §174-33 (setbacks from water and wetlands) of the Zoning Bylaws to <br /> allow for construction of a shed on property located in an R-3 Zoning District, and Little <br /> Neck Bay, at 19 Keel Way, Map 120 Parcel 138, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on August 9, 2019 and.August 16, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> September 11, 2019 at which time the following members of the Board of Appeals were <br /> present and acting throughout;Chairman,Jonathan Furbush,Board Members,Ron Bonvie, <br /> Scott Goldstein, and Associate Members, Sharon Sangeleer and James Reiffarth. Also <br /> present was Charlie Maintanis, Building Inspector. <br /> Mr. Wayne Tavares represented the homeowner for the shed. He said that he was in front <br /> of the Board a few months ago for a similar project because the Town has a bylaw with <br /> setback requirements for structures within 50 ft. of wetlands. This shed meets all building <br /> code requirements, and lot coverage is currently 23.76%, and the shed only is seven tenths <br /> of a percent. The shed size is 10' x 12', and is 25.5 ft. away from the top of the coastal <br /> bank. It is a portable structure, and is not fixed to the ground. An order of conditions was <br /> issued from the Conservation Commission. The shed will be located 5 ft. from the property <br /> line. The applicant said he is requesting 25 ft. from the coastal bank. <br /> GENERAL FINDINGS: <br /> Sharon read the Conservation and Board of Health comments into the record. The Board <br /> confirmed that the size of the shed is 10 ft. x 12 ft., and they reviewed the issued order of <br /> conditions from the Conservation Commission. <br /> There were no more comments from the Board or audience. <br /> 1 <br />
