MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> SEPTEMBER 11,2019 <br /> 413 Nathan Ellis Highway (Route 151): Petitioner, Industria Development Group, Inc. <br /> requests Variance relief under §174-31 (front yard setback of 75' from paper road), §174- <br /> 31 FN.14 (natural state buffer), §174-37(location of parking), §174-27.2.B2(c),and§174- <br /> 82.A.4 (use of drywells), §174-41 (m) (Landscaping within parking area), and §174-40 <br /> (access way separation (possibly) to allow for construction of a 9,975 sq. ft. retail use <br /> building together with accessory parking on property located in a C-2 Zoning District, <br /> (Map 72 Parcel 56A),Mashpee,MA. (Owner of record: Robert A. Lebewohl Family Trust <br /> 1980). (Continued from August 28, 2019 hearings at the request of the Attorney). <br /> Attorney Kirrane said the Board requested that the applicant pay a fee to the Town for <br /> purposes of having Charlie Rowley,Consulting Engineer review the proposed project.That <br /> fee was paid, and Charlie has been engaged by the Town to review the plans. Charlie gave <br /> some preliminary comments, and the applicant's engineers had discussions with Charlie <br /> relative to the issues that were raised. Attorney Kirrane believes that most of the issues <br /> were addressed, but some were not addressed because the engineers didn't get the revised <br /> information to the ZBA office until late in the afternoon before the meeting. <br /> Attorney Kirrane said the Board also asked that the applicants address certain issues <br /> relating to the paper road (Wampanoag Ave.) on the lot, and the traffic issues along Rte. <br /> 151.Also present was Chris King,Project Engineer for Atlantic Design,Kim Hazarvartian, <br /> with Transportation Engineering, (TEPP), LLC, and Doug,the building designer. <br /> Attorney Kirrane said a revised set of plans were submitted addressing many of the items <br /> that Charlie had raised in his engineering report. The building size has been reduced to <br /> 9,200 sq. ft. as opposed to the 9,975 sq. ft. resulting in a decrease in lot coverage from <br /> 19.6% to 18%. He said that Charlie Rowley wrote a preliminary report to the Board <br /> regarding the status of Wampanoag Avenue and what course would be taken to abandon <br /> that road. <br /> Chris King, Atlantic Design Engineers said he has been working closely with Charlie <br /> Rowley regarding the comments from his preliminary review that are detailed in his letter <br /> dated September 5, 2019. Chris said his first component was making sure there was a <br /> registered land surveyor to review the status of Wampanoag Ave., and certify the plan that <br /> was completed along with additional tie lines and monuments found so that Charlie can <br /> follow how they were fixed to the property based on the field survey. He said that Charlie <br /> requested defining the loading zone to the rear of the building, so pavement markings were <br /> added. The dumpsters were located outside Wampanoag Avenue outside the Groundwater <br /> Protection District. The employee parking spaces were designated to the rear of the <br /> building with employee only placards and signage. <br /> 7 <br />
