Perry Pg.: 302 <br /> 6 Autumn Drive <br /> (Map 22 Parcel 1 OB) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 3, 2020 by Owners, Thomas J. and Deborah L. Perry <br /> request a Written Finding under §174-17 of the Zoning Bylaws to allow for construction <br /> of a sunroom and covered porch of a pre-existing, non-conforming structure on property <br /> located in an R-5 Zoning District, at 6 Autumn Drive, Map 22 Parcel 1 OB, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 13, 2020 and November 20, 2020. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 9, 2020 as a virtual remote meeting at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Mr. Steve Cook, Cotuit Bay Design, and Mr. Perry were presenting this application. Mr. <br /> Perry would like to construct a sunroom on a patio that he built in the spring. He is also <br /> adding a covered porch. The current setback from the property line of the existing deck is <br /> 30.3 ft. on Autumn Drive, and the covered porch will be setback 31.3 ft., which is not <br /> getting any closer to the property line. The proposed lot coverage will be 18.4%. The house <br /> is pre-existing, non-conforming and sits 30 ft. from the property line on Attaquin St. The <br /> lot is 12,509 sq. ft. Mr. Perry said that the deck is on the ground, and is not elevated. <br /> The Board had a discussion regarding the existing patio, and determined that the deck <br /> project requires a footing but it is not creating a new non-conforming situation because a <br /> Written Finding allows for extensions and alterations. <br /> Chairman Furbush would like a revised plan depicting the distance from the existing <br /> pergola to the property line. There were no comments from the Board of Health or <br /> Conservation Departments. <br /> 1 <br />
