MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 24,2021 <br /> Mr. Reidy said that is correct. Whatever is being proposed is something that the Board can <br /> vote in favor or against. Attorney Kirrane does not get involved in this type of agreement, <br /> the only thing the Board is granting is variance relief and special permit relief under the <br /> zoning bylaws. The application just requires a Special Permit and or a Variance. <br /> Mr. Blaisdell agreed. Mr. Goldstein agreed. Attorney Kirrane said that the Little Neck Bay <br /> Association controls that property even though the ownership interest is in New Seabury. <br /> Mr. Morris asked if it was an implied easement. Attorney Kirrane said it's an agreement <br /> between the property owners. The Board should only be concerned with the zoning <br /> requests. <br /> Sharon read the Building Commissioner's email dated February 24, 2021 into the record. <br /> It requires a building permit because it's over 30 inches. <br /> Attorney Kirrane said that the request is for a 2 ft. variance. <br /> Mr. Bonvie made a motion that the Board issue a Special Permit to Owners, Jack Foster <br /> and Allyson Poole-Foster, and New Seabury Properties, LLC at 31 Wheelhouse Lane and <br /> 5 Waterline Drive North under §174-25 (H) (7) of the Zoning Bylaws to allow for <br /> construction of a stairs and platform for use in connection with a ramp and float complex <br /> on property located in an R-3 Zoning District,and Little Neck Bay District,Map 120 Parcel <br /> 165 and 171, Mashpee, MA, with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit(SP-24-26) Mass General Law 40A Section 9. <br /> 2. Site and Building Plan: Prepared for Jack Foster and Allyson Pool-Foster of 130 <br /> Clark Street Newton, MA, Project: 31 Wheelhouse Lane and 5 Waterline Drive <br /> North, Mashpee, MA. Assessor's ID: Map 120 Parcel 165 & Parcel 171. Drawing <br /> Title: Proposed Site Modifications, Additions, and Proposed Platform. Date: May <br /> 19, 2020, Revised November 13, 2020. Added Dimensions, Prepared by Cape & <br /> Islands Engineering. <br /> 3. Conditioned on all Town Department comments read into the record. Including but <br /> not limited to the Building Department letter read into the record. <br /> Mr. Gould seconded, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Bonvie, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes. <br /> All were in favor to issue a Special Permit. <br /> 4 <br />
