TCAM OF MASHPEE <br /> PLANNING BOARD <br /> SPECIAL PERMIT DECISION <br /> CLUSTER SUBDIVISION <br /> CAROL COOPER AND DONALD H. PEDERSON, JR. <br /> I . Proposal <br /> This decision concerns the application of Carol Cooper and Donald <br /> H. Pederson, Jr. for a Special Permit for a seven (7) lot cluster <br /> development on a 17.85 acre site, south of Old Falmouth/Barnstable <br /> Road, east of Leather Leaf Lane, west of Bates/Turner Road in <br /> Mashpee, Massachusetts. The land is shown on a plan entitled <br /> Topographical Plan of Land Located in Mashpee for Carol Cooper and <br /> Donald H. Pederson. Jr. ; prepared by Cape & Islands Surveying Inc. , <br /> Falmouth, MA; dated 14 June 1989. This plan shall be hereinafter <br /> referred to as the 'Site Plan' . <br /> II. Jurisdiction <br /> This decision is issued by the Mashpee Planning Board pursuant to <br /> - Sections 9.4 and other relevant Sections of the Mashpee Zoning <br /> By—laws in effect on the date of application, and• to the applicable <br /> provisions of Massachusetts General Laws, including Chapter 40A, <br /> . Section 9, which authorizes the Planning Board to issue a special <br /> permit for a cluster development, and to impose conditions upon its <br /> issuance of a Special Permit. <br /> III . Chronology <br /> A Special Permit application was filed on 27 January 1988. <br /> . A preliminary discussion of this application with the Board <br /> occurred on 1 March 1989. <br /> A Public Hearing was convened at Mashpee Town Hail on 19 April <br /> 1989 and subsequently continued on 17 May, 21 June, 5 July and <br /> 6 September 1989 by written agreement of the applicant. <br /> The Public Hearing was closed 11989, at which time the <br /> Board took the matter under advisement to prepare final Special <br /> Permit findings and conditions. <br /> On - I the Board voted to make the following findings and <br /> grant the Special Permit authorizing the construction of the <br /> project as depicted on the Site Plan documents, datedlu <br /> revised, and initialed by the Board Chairman, subject to the <br /> { conditions listed below. Anthony E. Ferragamo, Judy Mills, <br /> V. Louise Behrman and Patrick Coffey were all recorded as voting <br /> a in favor of this decision. No members were recorded in <br /> �x <br /> opposition. <br />
