Tony stated that the Board did receive correspondence from <br /> Cotuit Fire District and he read the letter. They stated <br /> that regarding the phosphate migration report at the <br /> proposed development, they do not think the question was <br /> answered. The report relies on 1986 data, and the soils <br /> at the site were not tested. F <br /> Mr Kirrane stated that they did not think the soils would { <br /> change from 1986 when they were last tested. . <br /> _ The Fire District stated that they believe it is most <br /> important that plant be governed with the most stringent <br /> � .. <br /> Conditions possible and run conscientiously on a daily basis. <br /> Mr. Kirrane presented a draft Special permit. He stated <br /> that it is similar to the one he submitted in Oct 1988 <br /> „t, s <br /> but revised to include phosphate removal at the plant, <br /> include the phasing schedule and a provision for renewal. and � <br /> or extension of the permit because of the time period to act <br /> on the Special Permit is 2 years and it might take LEQE <br /> longer to issue their permit. 4 <br /> Tom stated that the statue doesn't provide for an extension <br /> for that reason, <br /> Mr. Kirrane stated that the by law does provide for it. <br /> li <br /> The applicant also provided a final set of plans. He noticed there was no <br /> indication of it on the plan. It is now shown as art of <br /> the open space. <br /> p � <br /> f <br /> Tony stated that the applicant must delineate the area for <br /> road layout. ; <br /> Mr. Kirrane stated that they will deal with that issue with <br /> Mr. Jonas before the next hearing. <br /> Tony stated that the Board would like to see it delineated <br /> as a lot since it will be a finding in the Special Permit. <br /> Louise motioned to close the .public hearing Y Jud seconded <br /> the motion. All Board members were in favor. , <br /> The Board asked Torn and Lee to review the draft Special <br /> - P <br /> Permit for the next hearing.
