TOWN OF MASHPEE <br /> Mashpee Planning Board <br /> Town Hall, Mashpee, Massachusetts 02649 <br /> DECISION ' <br /> RE: Petition of Mashpee Investors Trust, Angelo Rosso, Trustee, <br /> for a Special Permit for Holland Mill Estates. <br /> A petition was filed by Mashpee Investor' s Trust, Hyannis, Massachusett <br /> for a Special Pernit for permission to cluster subdivide on property located <br /> on Route 28 and Holland Mill Road. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> and a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, March 5th, 1986 at 8 : 00 P.M. at which time the following members <br /> of the Planning Board were present and voting: Richard S. Dubin, Anthony <br /> Ferregamo, Richard Jonas, and Michael Stone. <br /> George A. Benway, Jr. , represented, Mashpee Investor' s Trust in this <br /> matter.There are forty-nine (49) proposed lots.The plan as submitted for <br /> the special permit has been revised and redrawn in accordance with <br /> Planning Board suggestions.On March 5, 1986, a vote was taken to accept <br /> the forty-nine (49) lot plan and grant the special permit with the following <br /> conditions. <br /> (a) A formal entry site plan by a landscape architect would be <br /> submitted for the approval by the Planning Broad prior to <br /> any construction occuring on the property. <br /> (b) The conservation commission order of conditions concerning <br /> the road construction over Red Brook would be required and <br /> a copy of these conditions forwarded to the Planning Board <br /> engineer for incorporation into the definitive plan and <br /> Planning Board records. <br /> Upon motion duly made and seconded the Board voted unianimously <br /> to grant the Special Permit with the following conditions: <br /> CONDITIONS <br /> 1. Prior to the issuance of any building permits a road bond <br /> will be required as stipulated in the By-Law. <br /> 2. The approval granted hereunder shall become void if the <br /> applicant has not applied for a building permit with <br /> respect to the land shown on the plan approved bytrthe z <br /> by the Planning Board on March 5, 1986, within pw) <br /> years from the date of approval of the Special Permit. <br />
