REGARDING <br /> Petition of applicant John C. Manoog, III, successor to Michael <br /> Coffey, Trustee of Clipper Realty Trust, for a Special Permit <br /> under Section 9. 4 of the Mashpee zoning By-law for development <br /> of a 35 lot cluster subdivision as "Great Hay Acres", adjoining <br /> the "Holland Mill Estates" subdivision on Route 28 in West <br /> Mashpee. The applicant also seeks approval under Massachusetts <br /> General Laws Chapter 41, Section 81 (inclusive) and the Rules <br /> and Regulations for the Subdivision of Land in Mashpee. <br /> II . JURISDICTION I� <br />_ 1 <br /> This decision is issued by the Mashpee Planning Board pursuant <br /> to Section 9 .4 of the Mashpee zoning By-law as it existed on <br /> November 5, 1986; and applicable provisions of Massachusetts <br /> General Laws, Chapter 40A, Section 9. Under this latter <br /> section, a Planning Board is granted the authority to impose <br /> conditions upon the issuance of a special permit. <br /> III . CHRONOLOGY OF APPLICATION <br /> On November 5, 1986 the applicant submitted a Preliminary Plan <br /> of the cluster subdivision to the Planning Board. On December <br /> 17, 1986 the Preliminary Plan was disapproved because of access <br /> problems and excess density. On January 7, 1987, the Planning <br /> Board favorably reviewed a revised Preliminary Plan, showing 35 <br /> lots. Applications for special permit approval and definitive <br /> plan approval were submitted on March 18, 1987 . A public <br /> hearing was held for special permit and definitive plan ' <br /> applications on May 6, 1987, notice of which was duly given to <br /> abutters in accordance with Massachusetts General Laws, Chapter <br /> 40A, Section 11, and by publication in the Falmouth Enterprise, 1 <br /> a newspaper of general circulation in the town of Mashpee, on <br /> April 22, and April 29, 1987, a co <br /> py of which is attached <br /> hereto. At the May 6 hearing, a request for a 30 day extension <br /> for Definitive Plan review was granted. <br />
