8. Pursuant to find ' <br /> ing seven, the applicant has agreed to <br /> install and maintain an emergency access gate on a way <br /> shown on the special permit plans that adjoins a 40 ' road <br /> layout within the above mentioned "South Cape Resorts" <br /> property, said gate having received the approval of the <br /> Police, Fire, and Public Works Departments of the Town of <br /> Mashpee. <br /> 9. The applicant will enforce protective covenants on lots to <br /> be built upon within the "Great Hay Acres subdivision. <br /> V. CONDITIONS <br /> 1. The applicant shall construct the project in accordance <br /> with the plans on record in the Planning Board files dated <br /> March 13 , 1987 and signed by the Planning Board Chairman <br /> on June 17, 1987. <br /> 2. The applicant will sign a road covenant that guarantees <br /> road improvements prior to the sale of any lots within the <br /> "Great Hay Acres" subdivision. <br /> 3 . The applicant pledges to maintain the emergency access <br /> gate and emergency ingress/egress routes to the "Great Ha <br /> Acres" property in a condition that will guarantee their <br /> utilization when needed. <br /> 4. The applicant has agreed that all open space areas within <br /> the "Great Hay Acres"subdivision be owned by a corporation <br /> or trust, as provided for in Section 9. 4.6 .0 of the <br /> Mashpee Zoning By-law, and that said open space areas f <br /> shall be restricted by deed, enforceable by the Town of <br /> Mashpee and attached and recorded as part of this special <br /> permit decision, to be left in perpetuity in their natural t <br /> state, except as allowed for under Sections 9.4.7 (a, b, <br /> and c) of the Mashpee Zoning By-law. <br /> 5. This special p permit shall be binding upon and inure to the <br /> benefit of the applicant and its heirs, successors, <br /> assigns and grantees as owners in interest of the "Great <br /> Hay Acres" subdivision. <br /> 6. This permit shall lapse within two years of the date of ' <br /> its filing with the Town Clerk if substantial progress has <br /> not been made toward the commencement of construction of <br /> the "Great Hay Acres"subdivision. i <br /> , J <br /> e y <br />
