There are many <br /> issues which need to be considered. Also, there is a lot of <br /> " correspondence from town of Falmouth and they need time to <br /> f review revisions to water quality report and comment. This <br /> cannot be accomplished this evening and cannot be <br /> accomplished by the 12th because the Board will not meet <br /> before then. The Board will not be able to address all <br /> these new issues, especially the engineering which needs to <br /> be reviewed by the Board's consulting engineer. Since the <br /> r: <br /> applicant cannot extend beyond this evening, the Board must <br /> make a decision tonight. <br /> The plan cannot be approved in this state and until a <br /> decision is made from Town Council. <br /> Charlie said that one of his comments originally made asked <br /> for adequate testing of soils, since the drainage issue was <br /> dependent upon testing. No additional testing had been <br /> done. <br /> Water Quality and Traffic report were received on April 5th. <br /> The Town Planner did not have time to review the nor did the <br /> DPW have the opportunity to review the traffic report. <br /> Judy made a motion to deny the subdivision. Louise seconded <br /> the motion. All Board members were in favor. <br /> The Board must then write out all reasons for denial and <br /> file with town clerk. <br /> i 1S. <br /> Tony asked if there was any public questions or comments . <br /> v' <br /> Jerry DePalma resident of Bugg River Bend-- since it was <br /> Y after the fact, he won't get into all his comments but he <br /> just wants to thank -the Board from the neighbors and thank <br /> them for the considerations given to the neighborhood. They <br /> are very pleased with the decision. <br /> Discussions <br /> yi The Board discussed Beechwood Point with Mike Ford. <br /> Tony told him he had spoken nth Attorney Warren (from Mike <br /> Ford's of f i-ce) regarding final security ($150,000) since it <br /> was never submitted. The Board would like to get a <br /> agreeable Letter of credit in place and will there remove the <br /> covenant on the building. Tony explained that he had berZ <br /> told that because of delay in payment to Bartlett, some <br /> damage to plantings was done. Bartlett feels they will be <br /> completing the work in end of April or early May. The board <br /> has a $100, 000 L/C now, if Bartlett is not paid Tony thought <br /> the Board can act on the L/C. <br />
