t ; Tony asked when does the time to act expire? Mike Ford had given the Board a letter extending the time the Board has to act up to and including April 12th. Tony explained that in addition to this issue, the Board has questions regarding water quality (this is first moment board has had to review the revision) , traffic. engineering modifications and park and recreation lots. There are many issues which need to be considered. Also, there is a lot of " correspondence from town of Falmouth and they need time to f review revisions to water quality report and comment. This cannot be accomplished this evening and cannot be accomplished by the 12th because the Board will not meet before then. The Board will not be able to address all these new issues, especially the engineering which needs to be reviewed by the Board's consulting engineer. Since the r: applicant cannot extend beyond this evening, the Board must make a decision tonight. The plan cannot be approved in this state and until a decision is made from Town Council. Charlie said that one of his comments originally made asked for adequate testing of soils, since the drainage issue was dependent upon testing. No additional testing had been done. Water Quality and Traffic report were received on April 5th. The Town Planner did not have time to review the nor did the DPW have the opportunity to review the traffic report. Judy made a motion to deny the subdivision. Louise seconded the motion. All Board members were in favor. The Board must then write out all reasons for denial and file with town clerk. i 1S. Tony asked if there was any public questions or comments . v' Jerry DePalma resident of Bugg River Bend-- since it was Y after the fact, he won't get into all his comments but he just wants to thank -the Board from the neighbors and thank them for the considerations given to the neighborhood. They are very pleased with the decision. Discussions yi The Board discussed Beechwood Point with Mike Ford. Tony told him he had spoken nth Attorney Warren (from Mike Ford's of f i-ce) regarding final security ($150,000) since it was never submitted. The Board would like to get a agreeable Letter of credit in place and will there remove the covenant on the building. Tony explained that he had berZ told that because of delay in payment to Bartlett, some damage to plantings was done. Bartlett feels they will be completing the work in end of April or early May. The board has a $100, 000 L/C now, if Bartlett is not paid Tony thought the Board can act on the L/C.
