Many <br /> f the streets are in need of repair and are on the no plow fist. 'Where was a public meeting held <br /> and all abutters were notified. Mr. i noted it was the first time he has seen a taking <br /> submitted by the Selectmen. Nornudly, a road taking is submitted by petition. fir. Fudala <br /> explained the street is in terrible shape and the Selectmen submitted the article for safety issues. <br /> Motion: Nor. B reni moved to recommend to town meeting to accept the layout of <br /> Shorewood Drive as presented in Article 1 , seconded by Mr. Koohria.n, voted <br /> unanimously. <br /> Article 1 : Holly Way, Elm Lane, Aug Drive, A#t quin Street,Pocknomet Street, Hornbeam <br /> Lane, Lantern Lane, Bee hwood Drive, Hemlock Circle,Fir Court. Mr. Fud.ala presented the <br /> plans for the ta.lan s shoving the layout of'the easements for the town ways. The Selectmen <br /> submitted the request and they are recommending the article due to the condition of the road. <br /> The Chair read the request for the record and asked Selectmen O'Hara if there was a public <br /> hearing and were the abutters notified. Selectman O'Hara stated the process has always been a <br /> public hearing and the process would have not come this far if the proper procedures were not <br /> followed. The Board members reviewed the plans. Mr. l ooharian had a question about the cost <br /> and who was paging for the takings. Mr.Fudala stated that the residents would be paying for the <br /> repairs through a betterment. Mr. Fudala stated once the DPW has come up with a construction <br /> cost, they come up with an estimate that is usuaily high and once the construction is completed, <br /> DPW will have a final cost which is divided up among all the residents on the strut usually up to <br /> 20 years. <br /> Motion: Mr. Bakar ni moved to recommend article 14 to see if the town wdl accept the <br /> layout of all the streets as listed in article I . bonded by Mr. Kooharian. voted <br /> unanimously. <br /> Article 1 : Ockwood Bay Road. 1r. Fudala presented the plan for the Ong showing the <br /> layout of the easement for ockood Bay load. This is a petitioned article. No questions or <br /> comments. <br /> Motion: Mr. Ba arini moved to ,recommend article 15 to town meeting,seconded by Mr. <br /> Kooharian. voted unanimously. <br /> Mr. Petersen asked if the drainage is included for these road takings. Mr. F udala stated this <br /> question has come up in the past and he is uncomfortable that they are not actually shown on the <br /> easements. He sued that as he recalls town counsel indicated that there is an implied easement <br /> r the draiwge on the road takings. He flied the town always takes the full layout which i <br /> 40 feet but we are talking beyond the layout. Some other issues the Board members were <br /> concerned with were if easements outside of the ragout are required are they included in the cost <br /> estimates, does the town have to maintain these and should they be included in the plan. Another <br /> issue is the slope easement and is the town responsible for Ift ing these easements. The <br /> Chair suggested that Mr. Fudala write up all of these issues,for the DPW Director so that going <br /> forward the board would remember these are the kind of questions they are going to ask.
