Gilmartin Certificate of Title: 201501 <br /> 5 Cross Street Lot# 11 (Block A) Plan: #6811-E <br /> (Map 123 Parcel 47) Lot#459 Plan: #11408-37 <br /> Mashpee, MA 02649 <br /> On December 30, 2013, a Petition was filed by Michael G. Gilmartin requesting a <br /> Written Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A <br /> §6 concerning continuance, extension or alteration of a pre-existing, non-conforming <br /> structure to allow for construction of a new single family dwelling on property located in <br /> an R-3 Zoning District at 5 Cross Street, (Map 123 Parcel 47), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 3, 2014 and January 10, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> On Wednesday, January 22, 2014 Public Hearings were held on the Petition at the <br /> Mashpee Town Hall at which time the following members of the Board were present and <br /> acting throughout,Vice Chairman,William A.Blaisdell,Board Member Ronald S.Bonvie, <br /> Richard J. Jodka, and Associate Members, Domingo K. DeBarros and Scott Goldstein. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Bert De Martin, Builder represented the Petitioners raze and replace project. <br /> He stated the engineer could not attend due to the weather conditions. Mr. De Martin <br /> submitted a site plan that depicts the existing and proposed dwelling bordering Pine Street <br /> and Cross Street. The dimensions of the existing dwelling is 18' x 36' and the proposed <br /> dwelling will be 22' x 68'. The proposed front setback is 21.6', the second front setback is <br /> 15.1', the rear setback is 6.3' and the height is 33.25'. <br /> Mr. De Martin said the proposed project is not in the Popponesset Overlay District <br /> and he met with Glen Harrington, Mashpee Health Agent at the property. <br /> Mr. Bonvie read the Board of Health comments; "Housing inspection documented <br /> (3) three legal bedrooms draft septic plan reviewed. Architectural plans need revising to <br /> depict three bedrooms with no other rooms that can be considered bedrooms." <br /> 1 <br />
