i <br /> DCPC Regulations <br /> (d) The district shall consist of the lard and water which reasonably belong in <br /> the district for the three following reasons: . <br /> 1. The critical area or-critical resource is-in need of protection. <br /> 2. It is the plannmg area which should be considered in adopting a <br /> coordinated system of regulations to protect -the critical resource or <br /> critical area. <br /> 3. The enslons or landmarks which form the b undary of the district <br /> are identifiable. <br /> SECTION 3. Who May Nominate an Area for Consideration as a District <br /> of Critical Planning Concern <br /> (a) Nomination of areas for consideration as districts of critical planning <br /> concern may be made to the Commission pursuant to Section 1 o(d) of the Act. <br /> SECTION 4. Procedure For Nominating A District <br /> (a) No nominations shall be filed with the Commission until after September <br /> ' , 1990. <br /> (b) A nominating party listed in Section 10(d) of the Act.may nominate an area <br /> for consideration as a district of critical planning concern by scheduling and <br /> attending a fare-application conference with Commission staff and then <br /> completing a District Nomination Form and sending two copies of such Form, <br /> by certified mail or hand delivery, to the Clerk, Cape Cod Commission, 3225 <br /> Main Street, Barnstable, Massachusetts 02630. In those instances where the <br /> nominating party is the Commission, the Executive Director of the <br /> Commission or his or her designee shall prepare the District Nomination <br /> Form. <br /> (c) The District Nomination Fornx shall include: <br /> 1. The name, address, and telephone number of the nominating.party; <br /> 2. A map of-the area to be nominated as a district of critical planning <br /> concern sufficient to identify affected properties and indicating the <br /> boundaries of the proposed district; - <br /> . A Written description of the proposed district, including references to <br /> any distinguishing landmarks, structures, roads, etc. which may act as <br /> boundary limits; <br /> 4. An explanation as to ashy the subject area should be designated <br /> district of critical planning concern,-including information as to:, <br /> (i) why the area presents a need for special regulation and <br /> planning to protect the district from development inconsistent with <br /> the proposed designation; <br /> (H) the types of problems associated with development of the area; <br /> and <br /> 2 <br />
